COMMENTS OF PLAINS ELECTRIC GENERATION AND TRANSMISSION COOPERATlVE, INC., ON ISSUANCE OF FACILITY OPERATING LICENSE TO OPERATE AT FIVE PERCENT, OF FULL POWER Plains Electric Generation and Transmission Cooperative, Inc. (" Plains" ), submits these comments on the issuance of the limited operating license on the Palo Verde Nuclear Generating Station, Unit 3 (" Palo Verde 3") as noticed in the Federal Register at 52 Fed. Reg. 10429 (Apr'il 1, 1987).

Plains understands that the operating license issued is limited to operation at five percent of full power and that Palo Verde 3 will not be able to operate at a greater level without specific Nuclear Regulatory Commission approval.

Plains reminds this Commission that it has filed comments in this Docket relating to activities of. El Paso Electric Company ("EPE"), a participant in Palo Verde 3, describing actions by EPE which create and maintain a situation inconsistent with the antitrust laws. These comments were filed on November 28, 1987. EPE responded to these comments on February 6, 1987. Plains replied on March 17, 1987, and EPE replied on March 27, 1987.
