By letter dated September 1,

1994, you applied for an amendment to the Nine Mile Point Unit 1 Operating License.

The proposed change would have modified the facility Technical Specification Section 3.2.2, "Hinimum Reactor Vessel; Temperature for Pressurization."

The Nuclear Regulatory Commission denied the amendment request by letter dated September 22,

1995, and issued a safety evaluation setting forth the basis for the denial.

The Notice of Denial of Amendment to Facility Operation License and Opportunity for Hearing was published in the ~Federa

~Re ister on September 29, 1995 (60 Fed.

50650).

By letter dated October 27,

1995, you requested, pursuant to 10 C.F.R. 5 2. 107, that the staff permit the withdrawal of the amendment request without prejudice to its future.resubmittal.

As provided in the September 29, 1995 ~ede al

Consequently, if you do not request a hearing, the NRC Staff's denial of your amendment request will become final agency action.
