1 INSERVICE TESTING By letter dated April 2, 1987, Niagara Mohawk submitted its updated Inservice Testing

( IST) Program Plan for Nine Mile Point, Unit 1.

This submittal was the subject of a working meeting on December 20, 1988.

From discussions held during that meeting, Niagara Mohawk submitted a revision to the IST plan dated January 18, 1989.

The revised plan was reviewed by the staff and was the subject of a working meeting on February 22 and 23, 1989.

Based on the agreements and resolutions reached during that meeting, Niagara Mohawk submitted a second revision to the plan dated March 28, 1989.

Further discussions resulted in the licensee submitting a modification to the March 28, 1989 plan dated June 20, 1989.

Included in these submittals and pursuant to 10 CFR 50.55a(g)(5),

Niagara Mohawk requested relief from certain ASME Code testing requirements for specific pumps and valves where the Code requirements are impractical within the limits of design and plant operational requirements.

The request for relief included an explanation and justification for each relief request and a proposal for alternative test procedures.

Per discussions with your staff, Niagara Mohawk requested the NRC to issue interim relief, for the requests discussed above, to cover the period of Unit 1 reload until the staff issues its final Safety Evaluation Report.

Generic Letter 89-04, "Guidance on Developing Acceptable Inservice Testing Programs,"

issued April 3, 1989, identified Nine Mile Point Unit 1 as a plant with a Safety Evaluation Report to be issued in the future.

The Generic Letter eliminates the need to issue a separate interim relief.

Therefore, Niagara Mohawk should continue to implement the Unit 1 IST Program as submitted through June 20, 1989.

If the staff's Safety Evaluation Report identifies that additional testing requirements are necessary, Niagara Mohawk will be required to comply at that time.
