SAFETY EVALUATION OF SECOND TEN-YEAR INTERVAL INSERVICE TESTItlG PROGRAM FOR PUMPS AND VALVES, NINE MILE POINT NUCLFAR STATION, UNIT tlO.

By letter dated March 28, 1989, whi ch superseded all previous IST program submittals, Niagara Mohawk Power Corporation (NMPC) submitted to the NRC the Nine Mile Point Nuclear Station, Unit No.

1 Second Ten-Year Interval Inservice Testing (IST) Program Plan, Revision 2, for pumps and valves.

The submitted program plan covers the second ten-year inspection interval from June 1, 1986 to June 1, 1996.

The program is based on the requirements of Section XI of

'he ASME Boiler and Pressure Vessel

Code, 1983 Edition through the Summer of 1983 Addenda.

The NRC staff, with technical assistance from EG&G Idaho, Inc.

(EG&G),

has reviewed and evaluated the IST program and requests for relief submitted for Nine t1ile Point Unit 1.

The staff adopts the evaluations and conclusions contained in the enclosed Technical Evaluation Report (TER) as prepared by EG&G.

We have determined that certain Section XI Code requirements cited by NMPC are impractical to perform at Nine Mile Point 1.

In such instances we have granted relief from those requirements.

The granting of relief is based upon the fulfillment of any commitments made by NMPC in its basis for each relief request and the alternative proposed testing.

One relief request was partially denied (TER Section 3.9.1.1),

11 relief requests were granted with certain conditions (TER Sections 2.1.1.1, 2.1.2.1, 2.1.2.2, 2.3.1.1, 2.5.1.1, 3.1.4.1, 3.4.1.1, 3.4.2.1, 3.4.2.2, 3.5.1.1, and 3.6.2.1),

and four relief requests were granted on an interim basis (TER Sections 3.2.1.1, 3.6.1.1, 3.7.2.1, and 3.10.1.1).

For the relief that is being granted, we have determined that the Code requirements are impractical and that the relief requests are authorized by law and will not endanger life, property or the common defense and security and are otherwise in the public interest giving due consideration to the

The requests for relief comply with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission has made appropriate findings as required by the Act and the Commission's rules and regulations in 10 CFR Chapter 1.

Accordingly, relief from certain provisions of Section XI of the ASME Boiler and Pressure Vessel Code and the applicable addenda is hereby granted, as described in the enclosed Safety Evaluation AND TER.

This completes our efforts in response to your submittal as listed above and TAC tto. 60450.
