APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Corporation Nine Mile Point Nuclear Station Docket No. 50-220 License No.

DPR-63 On August 18,

1981, licensee personnel discovered that both emergency diesel generators at Nine Mile Point Unit 1, Scriba, NY, were inoperable.

An NRC investigation into the circumstances surrounding this loss of operability was conducted at the facility on August 18-25 and September 1-3, 1981.

'As a

result of this investigation, and in accordance with the NRC Enforcement Policy, (47 FR 9987, March 9, 1982),

the followi'ng violations were identified:

A.

Technical Specification 3.6.3.e

states, in part, "For all reactor operating conditions except startup and cold shutdown, the following limiting conditions shall be in effect:

(1)

One operable diesel-generator power system and one energized 115 KV external line shall be available.

If this condition is not met, normal orderly shutdown will be initiated within one hour and the reactor will be in the cold shutdown condition within ten hours...."

Contrary to the above, no operable diesel-generator power system was available during the period of reactor operation from August 16, 1981 to August 18,

1981, and no normal orderly shutdown was initiated or cold

The inoperable condition of both Diesel Generators.

No.

102 and 103 resulted from the draining of the diesel fuel from the fuel supply lines of each diesel generator.

This, inoperable condition could have existed as early as August 6, 1981.

This is a Severity Level III violation (Supplement I).

B.

Technical Specification 6.8. 1 states, in part, "Written procedures...shall be established, implemented and maintained that meet or exceed the require-ments and recommendations of Sections 5 '

and 5.3 of ANSI N 18.7-1972..."

ANSI N 18.7-1972, paragraph 5.3.4.4 states, in part, "Monitoring of the performance of plant systems shall be required to assure...that engineered safety features and emergency equipment are in a state of readiness to maintain the plant in a safe condition if needed.

The limits...for significant process parameters should be identified.

The nature and frequency of thi s monitoring shall be covered by operating procedures, as appropriate."

Appendix A Contrary to the above, as of August 1S, 19S2 written procedures did not exist for routine monitoring by plant operators of the state of readiness of the emergency diesel generators.

Further, the limits for significant process parameters, such as the visibility or lack thereof, of fuel in the fuel oil filter sight glasses, were not identified to the operators.

This is a Severity Level IV violation (Supplement I)

Pursuant to the provisions of 10 CFR 2.201, Niagara Mohawk Corporation is hereby required to submit to this office within thirty days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including:

( 1) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved.
