APPENDIX A NOTICE OF VIOLATION Niagara Mohawk Power Corporation Docket No. 50-410 This refers to the inspection conducted by representatives of the Region I (Philadelphia) office at the Nine Mile Point Nuclear Station, Unit 2,
- Scriba, New York, of activities authorized by NRC License No.
CPPR-112.
During this inspection, conducted on March 26-23, 1979, the following apparent item of noncompliance was identified:
10 CFR 50, Appendix B, Criterion IX, states, in part, that:
"Measures shall be established to assure that special processes, including... nondestructive testing are controlled and accomplished..

in accordance with applicable codes..."
The Nine Mile Point PSAR, Appendix D, guality Assurance
- Program, Paragraph D.2.2, states, in part, that:
"NMPC will require Stone 5
Webster Engineering Corporation...
to maintain and implement separate but subsidiary guality Assurance Programs responsive to and designed to satisfy the intent of the guality Assurance Criteria of Appendix II Stone
& Webster Specification NMP2-P283B, Revision 3, dated Novem-ber 15, 1978 for "Shop Fabrication and Field Erection of Primary Containment Steel Plate Liner" stated the applicable code for construction of piping penetrations. is; ASME Section III, including the Summer 73 Addenda.
ASME Section III, Summer 73 Addenda, Article NB-5000, Paragraph NB 5231 states, in part:
"All weld joints... shall be radiographed."
Contrary to the above, as of March 21, 1979, SKW Specification P283B allowed ultrasonic examination of flued head to outer sleeve welds of piping penetrations and does not require radiographic examination of these welds.
Piping penetrations
- P265, P270, and P275 had been examined ultrasonically at the fabricators shop and had been accepted on site without radiographic examination.
