CLOSURE OF INVESTIGATION (014-2016-023}

Dear Mr. Marik:

This refers to an investigation conducted by the U.S. Nuclear Regulatory Commission's (NRC's)

Office of Investigations regarding activities at Fort Calhoun Station. The Office of Investigations initiated the investigation to determine whether a former Chicago Bridge & Iron Company general foreman, and an Omaha Public Power District crew leader steamfitter mechanic willfully falsified Work Order 496767-04 at the Fort Calhoun Station.

Based on the evidence developed during the investigation, the allegation that a Chicago Bridge

& Iron Company general foreman at the Fort Calhoun Station willfully falsified Work Order 496767-04 was substantiated as deliberate.

Based on the evidence developed during the investigation, the allegation that an Omaha Public Power District crew leader steamfitter mechanic at the Fort Calhoun Station willfully falsified Work Order 496767-04 was substantiated as deliberate.

On October 27, 2016, the NRC completed a review of the investigation findings and determined that, while the evidence in the case shows that the individuals deliberately falsified the work order, the deliberate falsification did not cause Omaha Public Power District to be in violation of 10 CFR Part 50, Appendix B, Criterion V, or any other NRC requirement because the activity performed under the work order was not safety-related. Therefore, the NRC plans no further action related to the alleged wrongdoing and considers this investigation closed.
