CLINTON POWER STATION, UNIT NO. 1 - WITHDRAWAL OF AMENDMENT REQUEST REGARDING DECOMMISSIONING LICENSING ACTION (RS-16-228)

Dear Mr. Hanson:

By letter dated November 17, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16323A008), Exelon Generation Company, LLC (Exelon),

submitted a license amendment request (LAR) to support its planned decommissioning of the Clinton Power Station, Unit No. 1 (CPS). The proposed LAR would have revised the facility operating license and the associated Technical Specification (TSs) to permanently defueled TSs consistent with the planned permanent cessation of reactor operations and permanent defueling of the reactor vessel at CPS.

Subsequently, by letter dated December 14, 2016 (ADAMS Accession No. ML16349A314),

Exelon withdrew the LAR. The December 14, 2016, letter also stated that Exelon had reversed its decision to permanently cease operations at CPS, withdrew its "Certification of Permanent Cessation of Operations" for CPS, dated June 20, 2016 (ADAMS Accession No. ML16172A137), and withdrew two other LARs related to decommissioning at CPS.

Based on the above, the proposed LAR for permanently defueled TSs at CPS is being treated as withdrawn. Notice of Consideration of Consideration of Issuance of the proposed LAR had not been published in the Federal Register.

The withdrawal of Exelon's "Certification of Permanent Cessation of Operations" for CPS and two other LARs related to decommissioning at CPS were addressed in separate correspondence (ADAMS Accession Nos. ML16354A485 and ML16354A142, respectively).

Since Exelon did not withdraw its decommissioning-related "Request for Exemption from Specific Provisions in 10 CFR 73.55(p)(1 )(i) and (p)(1 )(ii) Related to the Suspension of Security Measures in an Emergency or During Severe Weather," dated August 16, 2016 (ADAMS Accession No. ML16229A133), the NRC will continue its review.
