WATERFORD STEAM ELECTRIC STATION, UNIT 3- CONTINUATION OF ENFORCEMENT DISCRETION DURING ADOPTION OF NATIONAL FIRE PROTECTION ASSOCIATION STANDARD 805 (TAC NO. ME7602)

Dear Sir or Madam:

By letters dated December 18, 2013, and June 11, 2014 (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML13365A325 and ML14162A506, respectively), Entergy Operations, Inc. (Entergy), provided the U.S. Nuclear Regulatory Commission (NRC) supplements to its license amendment request (LAR) for Waterford Steam Electric Station, Unit 3 (Waterford 3), to adopt the National Fire Protection Association (NFPA)

Standard 805, "Performance-Based Standard for Fire Protection for Light-Water Reactor Electric Generation Plants," 2001 Edition, pursuant to Section 50.48(c) of Title 10 of the Code of Federal Regulations, dated November 17, 2011 (ADAMS Accession No. ML12027A049).

In the June 11, 2014, letter, Entergy requested confirmation that Waterford 3 enforcement discretion remains unchanged even though the unreviewed analysis methods (UAMs) are no longer utilized in the current amendment submittal. The NRC reinstated enforcement discretion based on the acceptability of both the NFPA 805 LAR package and UAM sensitivity analysis (ADAMS Accession No. ML120380257). The NRC acknowledges that Entergy is no longer utilizing these UAMs and are only utilizing NRC-accepted methods. The NFPA 805 LAR is currently under the license review process and, therefore, enforcement discretion will continue to be in place until the NRC dispositions the LAR.
