QUAD CITIES NUCLEAR POWER STATION, UNITS 1 AND 2-REQUEST FOR WITHHOLDING PROPRIETARY INFORMATION FROM PUBLIC DISCLOSURE (TAC NOS. MF2489 AND MF2490)
Dear Mr. Pacilio:
By letter dated July 16, 2013, (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13199A037), Exelon Generation Company, LLC (licensee) submitted an affidavit (Document ID 2127005) dated May 15, 2013, executed by Debabrata (Debu) Mitra-Majumdar, Ph.D, on behalf of Holtec International, requesting that information contained in two documents be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (1 0 CFR), Section 2.390. In a letter dated August 29, 2013 (ADAMS Accession No. ML13241A510), the NRC informed the licensee that the two documents did not meet the 10 CFR 2.390 criteria. The licensee subsequently indicated in a September 18, 2013, letter (ADAMS Accession No. ML13261A518), that both documents would be revised and resubmitted.
By letter dated January 22, 2014 (ADAMS Accession No. ML14024A561), the licensee submitted revisions of both documents. With this letter, the licensee submitted an affidavit dated January 6, 2014, executed by Debabrata (Debu) Mitra-Majumdar, Ph.D, on behalf of Holtec International, requesting that information contained in the following documents be withheld from public disclosure pursuant to 10 CFR, Section 2.390:
- 1. Holtec International Report No. Hl-21 04790, Revision 1, "Nuclear Group Computer Code Benchmark Calculations."
- 2. Holtec International Report No. Hl-2125245, Revision 4, "Licensing Report for Quad Cities Criticality Analysis for Inserts."
Nonproprietary versions of these documents are publicly available under ADAMS Accession No. ML14024A562.
The January 6, 2014, affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reason:
Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product.
We have reviewed the information provided with the January 22, 2014, letter in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the January 6, 2014, affidavit, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the information marked as proprietary that was included with the January 22, 2014, letter will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 1 03(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future, such that the information could then be made available for public inspection, you should promptly notify the NRC. You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
