The Nuclear Regulatory Commission (NRC) staff is reviewing the information provided by Entergy Nuclear Operations, Inc. (ENO) (the licensee) for James A. FitzPatrick Nuclear Power Plant (JAFNPP) in its license amendment request (LAR) dated May 7, 2013, (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML13128A165), and has concluded that additional information is necessary to complete its review. Please provide a response which addresses the following request for additional information (RAI):

Background

The renewed facility operating license condition (LC) 2.T currently states:

License Renewal Commitments/Conditions - The UFSAR supplement, as revised, describes certain future activities to be completed prior to and during the period of extended operation. ENF and ENO shall complete these activities in accordance with Appendix A of NUREG-1905, Safety Evaluation Report Related to the License Renewal of James A. FitzPatrick Nuclear Power Plant, issued April 2008. ENF and ENO shall notify the NRC in writing within 10 days of completion of those activities required prior to the period of extended operation and those activities required during the period of extended operation.

Consistent with Revisions 1 and 2 of NUREG-1800, Standard Review Plan for Review of License Renewal Applications for Nuclear Power Plants [SRP-LR], (ADAMS Accession Nos. ML052110007 and ML103490036),

the primary purpose of LC 2.T is to ensure that certain license renewal programs and activities are implemented and/or completed prior to the period of extended operation consistent with Appendix A commitments, and that the NRC receive notification of completion to enable verification by NRC inspection.

Issue The licensee proposes to remove activities in accordance with Appendix A of NUREG-1905, Safety Evaluation Report Related to the License Renewal of James A. FitzPatrick Nuclear Power Plant, issued April 2008 from LC 2.T to be replaced with regulatory commitments codified into the UFSAR no later than October 17, 2014.

The licensee also proposes to add language to LC 2.T clarifying that changes to the UFSAR, which includes the Appendix A list of commitments, be governed by 10 CFR 50.59 criteria. The licensee proposes for LC 2.T to state:

License Renewal Commitments - The UFSAR supplement, as revised, describes certain future programs and activities to be completed prior to the period of extended operation. ENF and ENO shall complete these regulatory commitments codified into the UFSAR no later than October 17, 2014. ENF and ENO shall notify the NRC in writing within 10 days of completion of these activities so that they can be verified by NRC Inspection. Following incorporation into the UFSAR, the need for prior Commission approval of any changes will be governed by 10 CFR 50.59.

However, since the issuance of the renewed license for Fitzpatrick, the NRC has reviewed and accepted other versions of LCs that can be summarized as follows:

The licensees UFSAR supplement submitted pursuant to 10 CFR 54.21(d), as revised during the license renewal application review process, and as supplemented by Appendix A of NUREG-XXXX, Safety Evaluation Report Related to the License Renewal of [Plant] dated [Month Year], describes certain programs to be implemented and activities to be completed prior to the period of extended operation.

a. The licensee shall implement those new programs and enhancements to existing programs no later than the PEO date.

b. The licensee shall complete those inspection and testing activities by the PEO date.

The licensee shall notify the NRC in writing within 30 days after having accomplished item (a) above and include the status of those activities that have been or remain to be completed in item (b) above.

These later versions of LCs, in effect, explicitly attach commitments made by the licensees to their corresponding UFSAR supplements so that licensees can manage the implementation of those activities described in the UFSAR in accordance with 10 CFR 50.59 rather than 10 CFR 50.90.

RAI Provide an explanation or rewording of the proposed LC language to further clarify how the commitments for FitzPatrick are related to the programs and activities as described in the UFSAR.
