UNITED STATES NUCLEAR REGULATORY COMMISSION WASHINGTON, D.C. 20555-0001 August 2, 2013 Ms. Maria Korsnick Chief Nuclear Officer Constellation Energy Nuclear Group, LLC 100 Constellation Way, Suite 200c Baltimore, MD 21202

SUBJECT:

STATUS OF 60-DAY RESPONSE TO ISSUANCE OF SEISMIC EVALUATION GUIDANCE RELATED TO THE NEAR-TERM TASK FORCE RECOMMENDATION 2.1, SEISMIC, FOR CALVERT CLIFFS NUCLEAR POWER PLANT, UNITS 1 AND 2; NINE MILE POINT NUCLEAR STATION, UNITS 1 AND 2; AND R.E. GINNA NUCLEAR POWER PLANT

Dear Ms. Korsnick:

By letter dated March 12, 2012,1 the Nuclear Regulatory Commission (NRC) issued a request for information per Title 10 to the Code of Federal Regulations, Section 50.54(f) (referred to as the 50.54(f) letter), to all nuclear power reactor licensees in response to lessons learned from Japan's March 2011, earthquake and subsequent tsunami. Enclosure 1 to the 50.54(f) letter includes Recommendation 2.1: Seismic, as part of the response to the Near-Term Task Force

[NTTF] Recommendations for Enhancing Reactor Safety in the 21st Century report, issued July 12, 2011.2 The 50.54(f) letter requested licensees to reevaluate the seismic hazards for their facilities, perform a seismic probabilistic risk assessment or a seismic margin assessment if necessary, and submit this information to the NRC. The information will be evaluated by the NRC staff to determine whether further regulatory action is warranted.

The 50.54(f) letter, as part of the "Required Response," states that within 60 days of the date of the NRC's issuance of guidance on screening and prioritization criteria, and the implementation details of the risk assessment, licensees are required to submit a letter to the NRC stating whether they will follow the NRC issued guidance or develop an alternative approach. The NRC staff endorsed the Electric Power Research Institute (EPRI) Final Draft Report 1025287, "Seismic Evaluation Guidance; Screening, Prioritization and Implementation Details (SPID) for the Resolution of Fukushima Near-Term Task Force Recommendation 2.1: Seismic" on February 15, 2013.3 The Nuclear Energy Institute (NEI) proposed the EPRI Final Draft Report 3002000704, "Seismic Evaluation Guidance; Augmented Approach for the Resolution of Fukushima Near-Term Task Force Recommendation 2.1: Seismic" and a revised schedule on April 9, 2013,4 and the staff accepted this approach and the schedule modifications on The 10 CFR 50.54(f) letter is available via the Agencywide Documents Access and Management System (ADAMS) under Accession No. ML12053A340.

The NTIF report is available under ADAMS AcceSSion No. ML111861807.

The SPID guidance document is found in ADAMS under Accession No. ML12333A170. The staff endorsement letter for the SPID guidance is found in ADAMS under Accession No. ML12319A074.

NEt's April 9, 2013 submittal is found in ADAMS under Accession No. ML13101A345, including the Augmented Approach guidance and schedule.

M. Korsnick

- 2 May 7,2013. 5 Since the NRC staff endorsed NEI's April 9, 2013, submittal, the NRC staff considers the modified schedule to be an acceptable response to Required Response, Item 1 of of the 50.54(f) letter for those licensees included as addresses to the 50.54(f) letter.

By letter dated April 26, 2013,6 Constellation Energy Nuclear Group, LLC (CENG) submitted their 60-day response committing, in part, to submitting a "schedule for implementing the Expedited Seismic Evaluation Program (ESEP) activities and the Seismic Risk Assessments" for the CENG plants. By letter dated June 28,2013/ CENG submitted a supplement to their 60-day response committing to the NRC-endorsed schedule, described in NEl's April 9, 2013, submittal, for the ESEP and risk evaluations if necessary. The CENG also provided a commitment prioritizing the CENG plants in its June 28, 2013, letter.

The NRC staff held a conference call with CENG staff on July 19,2013,8 and stated, in part, that the NRC will prioritize all nuclear power plants following submittal of the hazard reevaluations per the 50.54(f) letter.

This letter serves as an acknowledgement of receipt of your 60-day response letter. The NRC staff acknowledges that you have provided the information specified in the 50.54(f) letter,, Required Response, Item 1. The NRC staff has no additional questions at this time, however, we expect that the licensees communicate any changes to the schedules identified in 60-day response letters.

Should you have any questions regarding this letter, please contact Ms. Lisa Regner at 301-415-1906 or Lisa.Regner@nrc.gov.

Sincerely, Michele G. Evans, Director Division of Operating Reactor Licensing Office of Nuclear Reactor Regulation cc: See enclosed list Listserv The NRC staff endorsement letter for the Augmented Approach guidance and schedule is found in ADAMS under Accession No. ML13106A331.

CENG's April 26, 2013, letter can be found in ADAMS under Accession No. ML13120A105.
