Ginna Nuclear Power Plant, LLC (Ginna), and Calvert Cliffs Nuclear Power Plant, LLC (CCNPP), Units 1 and 2. In Reference (a), CENG stated its intention to utilize the Expedited Seismic Evaluation Process (ESEP) defined in Reference (c) followed by plant risk evaluations in accordance with Reference (d) or Reference (e). At the time of Reference (a), the NRC had not endorsed or accepted the ESEP. Thus, in Reference (a), CENG provided a commitment to submit a schedule for implementing the ESEP activities and the Seismic Risk Evaluations for NMP1, NMP2, Ginna, and CCNPP Units 1 and 2 within 60 days after NRC's endorsement, acceptance or rejection of the Augmented Approach Guidance.

On May 7, 2013 (Reference f), the NRC endorsed the ESEP and the schedule submitted by the Nuclear Energy Institute in Reference (c).

Thus, CENG supplements its 60-day response to Request for Information: Near-Term Task Force Recommendation 2.1, Seismic Reevaluation (Reference a) by affirming its intentions to utilize the ESEP as endorsed by the NRC in Reference (f) in addition to the NRC endorsed guidance in the Screening, Prioritization and Implementation Details (SPID) report (Reference d), for those plants that do not screen out of ESEP and/or Seismic Risk Evaluations based on applicable screening criteria. The schedule for implementing the ESEP activities and Seismic Risk Evaluation for NMPI, NMP2, Ginna, and CCNPP Units 1 and 2 are as follows:

Document Control Desk June 28, 2013 Page 3 Milestone Date CENG will submit ESEP reports for the CENG sites/units December 31, 2014 If any CENG site/unit does not screen out based on the Augmented December 31, 2016 Approach screening criteria, the applicable site(s)/unit(s) will complete the ESEP Modifications not requiring outages two years after the ESEP report submittal If any CENG site does not screen out based on the Augmented Approximate dates for the second Approach screening criteria, the applicable site(s)/unit(s) will complete refueling outages after December the ESEP Modifications requiring outages within two refueling outages 2014 for CCNPP Units 1 and 2, after December 2014 Ginna, NMP 1, and NMP2 are defined in Attachment (4)

If Ginna does not screen out based on SPID screening criteria, Ginna June 30, 2017 will complete a Seismic Risk Evaluation (with a SFP Evaluation and High Frequency Confirmation)

If any other CENG site/unit does not screen out based on SPID December 31, 2019 screening criteria, the applicable site(s)/unit(s) will complete the Seismic Risk Evaluation (with a SFP Evaluation and High Frequency Confirmation)

This letter contains regulatory commitments as listed in Attachment (1).

In addition, Attachment (4) defines the approximate dates for the start of the second refueling outage after December 2014 for CCNPP Units I and 2, Ginna, NMP1, and NMP2. CENG is requesting that these dates be withheld from public disclosure in accordance with 10 CFR 2.390. An affidavit supporting the request for withholding from public disclosure is provided as Attachment (2). Attachment (3) provides a redacted version of Attachment (4).

AFFIDAVIT I, Mary G. Korsnick, Chief Nuclear Officer of Constellation Energy Nuclear Group, LLC, for Calvert Cliffs Nuclear Power Plant, LLC, Nine Mile Point Nuclear Station, LLC, and R.E. Ginna Nuclear Power Plant, LLC (together, the Licensees), do hereby affirm and state:

1. I am authorized to execute this affidavit on behalf of the Licensees.
2. The Licensees are providing privileged industrial information that should be held in confidence by the NRC pursuant to the policy reflected in 10 CFR §§ 2.390(a)(4) and 9.17(a)(4), because:
i. This information is and has been held in confidence by the Licensees.

ii. This information is of a type that is customarily held in confidence by the Licensees, and there is a rational basis for doing so because the information contains sensitive industrial information concerning future refueling outage dates of the Licensees.

iii. This information is being transmitted to the NRC voluntarily and in confidence.

iv. This information is not available in public sources and could not be gathered readily from other publicly available information.

v. Public disclosure of this information would create substantial harm to the competitive position of the Licensees by disclosing their offline schedules.

The following are the dates for the start of the second refueling outages after December 2014 for Nine Mile Point Nuclear Station, LLC (NMPNS), Units 1 (NMP1) and 2 (NMP2), R.E. Ginna Nuclear Power Plant, LLC (Ginna), and Calvert Cliffs Nuclear Power Plant, LLC (CCNPP), Units 1 and 2. Constellation Energy Nuclear Group, LLC is requesting that these dates be withheld from public disclosure in accordance with 10 CFR 2.390. An affidavit supporting the request for withholding from public disclosure is provided as Attachment (2).
