BELLEFONTE NUCLEAR PLANT, UNITS 1 AND 2 - STATUS OF 60-DA Y RESPONSE TO ISSUANCE OF SEISMIC EVALUATION GUIDANCE RELATED TO THE NEAR-TERM TASK FORCE RECOMMENDATION 2.1, SEISMIC (TAC NOS. MF1626 AND MF1627)
Dear Mr. Skaggs:
By letter dated March 12, 2012,1 the Nuclear Regulatory Commission (NRC) issued a request for information per Title 10 to the Code of Federal Regulations, Section 50.54(f) (referred to as the 50.54(f) letter), to all nuclear power reactor licensees in response to lessons learned from Japan's March 2011, earthquake and subsequent tsunami. Enclosure 1 to the 50.54(f) letter includes Recommendation 2.1: Seismic, as part of the response to the Near-Term Task Force (NTTF] Recommendations for Enhancing Reactor Safety in the 21st Century report, issued July 12, 2011.2 The 50.54(f) letter requested licensees to reevaluate the seismic hazards for their facilities, perform a seismic probabilistic risk assessment or a seismic margin assessment if necessary, and submit this information to the NRC. The information will be evaluated by the NRC staff to determine whether further regulatory action is warranted.
The 50.54(f) letter, as part of the "Required Response," states that within 60 days of the date of the NRC's issuance of guidance on screening and prioritization criteria, and the implementation details of the risk assessment, licensees are required to submit a letter to the NRC stating whether they will follow the NRC issued guidance or develop an alternative approach. The NRC staff endorsed the Electric Power Research *Institute (EPRI) Final Draft Report 1025287, "Seismic Evaluation Guidance; Screening, Prioritization and Implementation Details (SPID) for the Resolution of Fukushima Near-Term Task Force Recommendation 2.1: Seismic," on February 15, 2013.3 The Nuclear Energy Institute (NEI) proposed the EPRI Final Draft Report 3002000704, "Seismic Evaluation Guidance; Augmented Approach for the Resolution of Fukushima Near-Term Task Force Recommendation 2.1: Seismic," and a revised schedule on The 10 eFR 50.54(1) letter is available via the Agencywide Documents Access and Management System (ADAMS) under Accession No. ML12053A340.

- 2 April 9, 2013.4 The NRC staff accepted this approach and the schedule modifications on May 7,2013. 5 Since the NRC staff endorsed NEl's April 9,2013, submittal, the NRC staff considers the modified schedule to be an acceptable response to Required Response, Item 1 of Enclosure 1 of the 50.54(f) letter for those licensees included as addressees to the 50.54(f) letter.
This letter serves as an acknowledgement of receipt of your 60-day response letter provided on April 26, 2013.6 The NRC staff acknowledges that you have provided the information specified in the 50.54(f) letter, Enclosure 1, Required Response, Item 1. The NRC staff notes that you intend to respond to the 50.54(f) letter by following the approach described in NEl's April 9, 2013, Submittal "on the schedule provided in Reference 3 [NEl's April 9, 2013, submittal], or prior to issuance of the operating license for the milestones associated with completing plant modifications." The NRC staff finds this schedule modification acceptable and has no additional questions at this time, however, we expect that Tennessee Valley Authority (TVA) communicates any changes to its schedule for Bellefonte Nuclear Power Station.
