CRYSTAL RIVER NUCLEAR PLANT - CLOSEOUT OF GENERIC LEITER 2004-02, "POTENTIAL IMPACT OF DEBRIS BLOCKAGE ON EMERGENCY RECIRCULATION DURING DESIGN-BASIS ACCIDENTS AT PRESSURIZED WATER REACTORS" (TAC NO. MC4678)

Dear Mr. Hobbs:

On September 13, 2004, the Nuclear Regulatory Commission (NRC) issued Generic Letter (GL) 2004-02, "Potential Impact of Debris Blockage on Emergency Recirculation during Design Basis Accidents at Pressurized-Water Reactors," as part of the NRC's efforts to assess the likelihood that the emergency core cooling system (ECCS) and containment spray system (CSS) pumps at domestic pressurized-water reactors (PWRs) would experience a debris-induced loss of net positive suction head margin during sump recirculation. The NRC issued GL 2004-02 to all PWR licensees to request that addressees (1) perform a mechanistic evaluation using an NRC-approved methodology of the potential for the adverse effects of post-accident debris blockage and operation with debris-laden fluids to impede or prevent the recirculation functions of the ECCS and CSS following all postulated accidents for which the recirculation of these systems is required, and (2) implement any plant modifications that the above evaluation identifies as being necessary to ensure system functionality. Addressees were also required to submit information specified in GL 2004-02 to the NRC in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 50.54(f). Additionally, in GL 2004-02, the NRC established a schedule for the submittal of the written responses and the completion of any corrective actions identified while complying with the requests in the GL.

GL 2004-02 required a response from all holders of operating licenses for pressurized-water nuclear power reactors, except those who have ceased operations and have certified that fuel has been permanently removed from the reactor vessel. On February 20, 2013 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML13056A005), Florida Power Corporation (the licensee) certified to the NRC, pursuant to 10 CFR 50.82, that it had permanently ceased operation of the Crystal River Nuclear Plant, Unit 3 (CR-3), and permanently removed the fuel from the reactor. With these certifications, the licensee for CR-3 acknowledged that the 10 CFR Part 50 license no longer authorizes operation of the reactor or emplacement or retention of fuel in the reactor vessel. The NRC staff acknowledged that CR-3's 10 CFR Part 50 operating license no longer authorizes operation of the reactor or emplacement or retention of fuel in the reactor vessel in a letter dated March 13, 2013 (ADAMS Accession No. ML13058A380).

T. Hobbs - 2 On March 20, 2013, the licensee submitted a letter to withdraw a commitment associated with GL 2004-02 (ADAMS Accession No. ML13080A431). In its letter, the licensee reiterated that, pursuant to 10 CFR 50.82(a)(2), CR-3 is no longer authorized to operate the reactor or place or retain fuel in the reactor vessel, and as such, CR-3 will not provide further information in response to GL 2004-02, and is withdrawing the commitment contained in its February 26, 2009, letter, "Crystal River Unit 3 - Response to Crystal River Nuclear Plant, Unit 3 - Request for Additional Information, Regarding Response to Generic Letter 2004-02 (TAC NO. MC4678)"

(ADAMS Accession No. ML090620392).

The NRC staff acknowledges the licensee's withdrawal of its commitment to address the in-vessel downstream effects within 90 days of issuance of the final NRC staff Safety Evaluation on WCAP-16793, "Evaluation of Long-Term Cooling Considering Particulate, Fibrous and Chemical Debris in the Recirculating Fluid," and agrees that no further information in response to GL 2004-02 is needed. The NRC staff will close TAC 4678.
