WATTS BAR NUCLEAR PLANT, UNIT 1 - WITHDRAWAL ACKNOWLEDGEMENT RELATED TO LICENSE AMENDMENT REQUEST TO MODIFY TECHNICAL SPECIFICATION 4.3.1, "CRITICALITY" (TAC NO. MF0314)

Dear Mr. Shea:

By letter dated November 20,2012 (Agencywide Documents Access and Management System Accession No. ML12333A242), you submitted an application for license amendment request to change the Watts Bar Nuclear (WBN) Unit 1 Technical Specification (TS) 4.3.1.1.d to clarify the distinction between TS 4.3.1.1.d and TS 4.3.1.1.e.2 requirements for storage of new and spent fuel assemblies in the spent fuel racks. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the Nuclear Regulatory Commission (NRC) staff to complete its detailed technical review.

The NRC staff identified the proposed wording in this WBN Unit 1 TS amendment request is different from that of the proposed TSs TVA already submitted for the WBN Unit 2 operating license which is currently under our review. Because the same spent fuel pool is shared by both WBN units, its related TSs for both units should be identical. We discussed this with your staff during a conference call on March 1, 2013. Your staff acknowledged these differences in the two applications and considered to withdraw the WBN Unit 1 TS change request and resubmit it with the approved wording for the corresponding portion of Unit 2 TS after the NRC has completed its review.

By letter dated March 21, 2013 (ADAMS ML13084A053), you requested to withdraw the application from NRC review and resubmit it later. The NRC staff acknowledges your request to withdraw the application. NRC staff activities on the review have ceased and the associated Technical Assignment Control number has been closed. If you decide to resubmit the request, please ensure it is consistent with that of approved Unit 2 TSs.
