CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2 UNACCEPTABLE ACCEPTANCE REVIEW WITH OPPORTUNITY TO SUPPLEMENT - LICENSE AMENDMENT REQUEST REGARDING:

ELIMINATE SECOND COMPLETION TIMES LIMITING TIME FROM DISCOVERY OF FAILURE TO MEET AN LCO (TAC NOS. MF0617 AND MF0618)

Dear Mr. Gellrich:

By letter dated January 28,2013, Calvert Cliffs Nuclear Power Plant, LLC (the licensee) submitted a [license amendment/relief] request for Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2. The proposed amendment would eliminate second completion times limiting time from discovery of failure to meet a limiting condition for operation (LCO). The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff's acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Consistent with Section 50.90 of Title 10 of the Code of Federal Regulations (10 CFR), an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Section 50.34 of 10 CFR addresses the content of technical information required.

This section stipulates that the submittal address the design and operating characteristics, unusual or novel design features, and principal safety considerations.

The NRC staff has reviewed your application and concluded that the information delineated in the enclosure to this letter is necessary to enable the NRC staff to make an independent assessment regarding the acceptability of the proposed amendment request in terms of regulatory requirements and the protection of public health and safety and the environment.

In order to make the application complete, the NRC staff requests that the licensee supplement the application to address the information requested in the enclosure by April 2, 2013. This will enable the NRC staff to complete its detailed technical review. If the information responsive to the NRC staff's request is not received by the above date, the application will not be accepted for review pursuant to 10 CFR 2.101, and the NRC staff will cease its review activities associated with the application. If the application is subsequently accepted for review, you will be advised of any further information needed to support the NRC staff's detailed technical review by separate correspondence.

CALVERT CLIFFS NUCLEAR POWER PLANT. UNIT NOS. 1 AND 2 DOCKET NOS. 50-317 AND 50-318 TAC NOS. MF0617 AND MF0618 In letter dated January 28,2013 (Agencywide Documents Access and Management System Accession Number ML13030A133), Calvert Cliffs Nuclear Power Plant, LLC, submitted a license amendment request for Calvert Cliffs Nuclear Power Plant Unit 1 and 2 (CCNPP) Technical Specifications (TS). The proposed amendment would revise CCNPP TSs 3.6.6, 3.7.3, 3.8.1, 3.8.9, and TS Example 1.3-3 by eliminating second completion times from the TSs in accordance with TS Task Force Traveler 439, "Eliminate Second Completion Times Limiting Time from Discovery of Failure to Meet an LCO [limiting condition for operation]."

Basis for the Request In your application you stated that TS Example 1.3-3 will be revised to:

It is possible to alternate between Conditions A, B, and C in such a manner that operation could continue indefinitely without ever restoring systems to meet the LCO. However, doing so would be inconsistent with the basis of the Completion Times. Therefore, there shall be administrative controls to limit the maximum time allowed for any combination of Conditions that result in a single contiguous occurrence of failing to meet the LCO. These administrative controls shall ensure that the Completion Times for those Conditions are not inappropriately extended.

Reguest for Supplemental Information Describe the administrative controls that are referenced in the above paragraph. Also include in your response when these administrative controls will be implemented.

Regulatory Analysis Basis 10 CFR 50.90, "Application for amendment of license, construction permit, or early site permit" states:

-2 "Whenever a holder of a license, including a construction permit and operating license under this part, and an early site permit, combined license, and manufacturing license under part 52 of this chapter, desires to amend the license or permit. application for an amendment must be filed with the Commission, as specified in §§ 50.4 or 52.3 of this chapter, as applicable, fully describing the changes desired, and following as far as applicable, the form prescribed for original applications."
