Draft MD 10.158, Section "Organizational responsibilities," paragraph (d) states, "Prior to making non-concurrence records publicly available, assure that records are screened in accordance with all requirements related to the public release of agency records."

This issue required coordination and review by several NRC offices, and we prioritized it in accordance with a number of other high priority generic communication tasks.

I submitted a FOIA request yesterday and received an acknowledgement letter today (FOIA 2011-00096). I would prefer to have the document released publically via ADAMS, but I wanted you to be aware of the FOIA request, I am able to view and print the document from internal ADAMS, but I do not believe I am allowed to share it since it has not been publically released. There are a few politicians and interveners who have been assisting me in addressing my concerns regarding Callaway, so I need a copy of the Non-Concurrence Form which I can share with people outside the NRC.

Stacy, I met with Dave today and reviewed Section C of Form 757.

The procedure only says I need to be "informed" by the sponsor so you are not required to meet with me. My input to Dave was that I would like the following blocks checked at the bottom of Section C:

NON-CONCURS WANTS NCP FORM PUBLIC If you would like to meet with me tomorrow to debrief the process, I am more than willing to come down to One White Flint. Otherwise, I'm satisfied with the discussion I had today with Dave (assuming the NCP form will be a public record).

Stacey, Please see the attached page from the Draft Non-Concurrence Policy. I've highlighted where I believe we are at in the policy.

Regardless of where we are at in the process, I am available to meet with you and Dave to discuss Section C of Form 757 any time that you would like. It will be a more productive (i.e. shorter) meeting if I can see the response in Section C ahead of time (and a meeting might not be required based on the response).

I am taking off work this Friday and the following Monday morning. My Outlook calendar is up to date regarding my time off and my workday meetings/commitments. I can come down to OWF any time, but I often attend the 1:30 OpE Clearinghouse meeting so any time before or after that meeting works best for me. The meeting typically ends between 1400 and 1430 based on the number of incidents being screened.
