Eric, I'm glad you are able to join my discussion with Roy tomorrow.

I didn't immediately get back to your email below because I was waiting to see how things flesh out on~the IN. I had a couple of productive discussions with Dave Beaulieu over the past few days. He understands the facts, issues and concerns and is doing his best to incorporate what he can.

Tomorrow I was hoping to discuss not just the IN but the upcoming PRB on my 10CFR2.206 petition. I am still not certain how we as an agency view the facts of the October 21, 2003 incident, the testimonies provided by Ameren and the conclusions reached by Region IV. I don't expect to find answers to these tomorrow but I hope to get an idea of what is the most productive path forward.

Discuss IN on Callaway Plant

Eric, Do you have time to discuss the IN on Callaway Plant with me? I spoke with Dave Beaulieu (the individual writing it). I believe he adequately understands the incident but for some reason is not willing to directly state the facts. I do not believe that his hesitation has anything to do with his personal ethics. It appears to me that NRC policy is not to directly acknowledge wrong doing by the utilities but to instead encode wrong doing in ambiguous language.

Dave's IN is 90% what I am looking for. My suggested additions amount to no more than several sentences and the changing of a few key words and phrases.

If possible, I would like to meet with you as part of the open door policy to try to understand our organizational reluctance to succinctly and unambiguously state the facts regarding the October 21, 2003 passive reactor shutdown.

My meeting today with Dave was productive, but it appears to me that a higher level of management must weigh in on the slight changes I would like to see to the IN.
