Dear Mr. Denton:

Transmitted herewith, in accordance with the requirements of 10 CFR 50.59 and 10 CFR 50.90, is an application for amendment to Appendix A (Technical Specifications) to Operating License DPR-49 for the Duane Arnold Energy Center.

This application, consisting .of proposed Technical Specification change RTS-148, has been reviewed and approved by the DAEC Operations is Committee and the DAEC Safety Committee. The enclosed license amendment Order for required in order to comply with the Nuclear Regulatory Commission Modification of License and Grant of Extension of Exemption (dated January 13, 1981) and Modification of January 13, 1981 Order (dated January 19, 1982). CFR This application, therefore, is considered exempt from fee pursuant to 10 170.22, Footnote 2.

A The purpose of this application is to amend the DAEC Appendix signal from Technical Specifications to revise a Group I Containment Isolation low-low-low water level.

As indicated in the attached affidavit, we hereby request that NEDE-30021 be withheld from public disclosure in accordance with the provisions of 10 CFR 2.790.

The Commission Orders identified above require major containment modifications to be completed prior to the start of DAEC Cycle 7 and remaining minor containment modifications prior to July 1, 1983. Startup from Cycle 7 is currently scheduled for mid April, 1983. In the generic Mark 1 submittal (MI-G-41, June 14, 1981) MSIV level change was classified as a major modification but was annotated with the comment "Applicability in Question."

Subsequent analysis, as discussed in the attached NEDE-30021, has demonstrated that installation of the low-low set logic is adequate without MSIV level change to mitigate the load cases of concern. As low-low set logic is being installed this outage, a basis is, therefore, provided to reclassify the MSIV level change as a minor modification. However, we request that the NRC approve this application during this outage to avoid the need for reclassification of MSIV level to minor.

Three signed and 37 additional copies of this application are transmitted; five of these copies have the proprietary GE report NEDE-30021 attached. These five copies are stamped in the upper right hand corner as "Company Proprietary." This application, consisting of the foregoing letter and enclosures, is true and accurate to the best of my knowledge and belief.
