SHEARON HARRIS NUCLEAR POWER PLANT, UNIT 1 - ACCEPTANCE FOR REVIEW OF MEASUREMENT UNCERTAINTY RECAPTURE POWER UPRATE LICENSE AMENDMENT REQUEST (TAC NO. ME6169)

Dear Mr. Jefferson:

By letter dated April 28, 2011 (Agencywide Documents and Access Management System Accession No. ML11124A180), Carolina Power & Light Company (CP&L, the licensee),

submitted a license amendment request (LAR) for the Shearon Harris Nuclear Power Plant, Unit 1 (HNP). The proposed amendment will increase the rated thermal power (RTP) level from 2900 megawatts thermal (Mwt) to 2948 Mwt, and make technical specifications changes as necessary to support operation at the uprated power level. The proposed change is an increase in RTP of approximately 1.66 percent. The proposed uprate is characterized as a measurement uncertainty recapture (MUR) using the Cameron Leading Edge Flow Meter CheckPlus System to improve plant calorimetric heat balance measurement accuracy. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the U.S. Nuclear Regulatory Commission (NRC) staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

On June 8, 2011, the NRC staff notified CP&L by phone that the LAR required supplemental information to satisfy the NRC's acceptance review criteria. The NRC staff and CP&L held an additional call on June 10, 2011. By letter dated June 23, 2011, CP&L provided the supplemental information.

The NRC staff has reviewed your application and the supplemental information and has concluded that they provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review of the proposed request and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staff's ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed for the NRC staff to complete its technical review, you will be advised by separate correspondence.
