REQUEST FOR ADDITIONAL INFORMATION REGARDING 2011 DECOMMISSIONING FUNDING STATUS REPORT (TAC NOS. ME5970, ME5971, ME5972, ME5973, AND ME5974)

Gentlemen:

On March 31, 2011, Carolina Power & Light Company and Florida Power Corporation (together, the licensees) submitted to the Nuclear Regulatory Commission (NRC) the 2011 Decommissioning Funding Status (DFS) report (Agencywide Documents Access and Management System Accession No. ML110950366) for Brunswick Steam Electric Plant Units 1 and 2, Crystal River Unit 3 Nuclear Generating Plant, Shearon Harris Nuclear Power Plant, Unit 1, and H.B. Robinson Steam Electric Plant, Unit 2 as required under Title 10 of the Code of Federal Regulations (10 CFR) 50.75(f)(1)

The NRC staff has reviewed your submittal and finds that additional information as described in the enclosed request for additional information is needed before the review can be completed.

In order for the NRC staff to complete its review in a timely manner, please provide your response within 30 days from the date of this letter.

UNIT NO.1 DOCKET NOS. 50-325 AND 50-324 DOCKET NO. 50-302 DOCKET NO. 50-261 DOCKET NO. 50-400 On March 31,2011, Carolina Power & Light Company and Florida Power Corporation (together, the licensees) submitted to the Nuclear Regulatory Commission (NRC) the 2011 Decommissioning Funding Status (DFS) report (Agencywide Documents Access and Management System Accession No. ML110950366) for Brunswick Steam Electric Plant Units 1 and 2 (BSEP), Crystal River Nuclear Generating Plant, Unit 3 (CR-3), Shearon Harris Nuclear Power Plant, Unit 1 (HNP), and H.B. Robinson Steam Electric Plant, Unit 2 (HBRESP), as required under Title 10 of the Code of Federal Regulations (10 CFR) 50.75(f)(1). To complete its review, the NRC staff requests the following additional information.

RAI-1: Citation for real rate of returns:

In its March 31, 2010, DFS report, the licensees reported various levels of assumed cost escalation rates and assumed earnings rates for the various co-owners and portions of the trust funds.

As stated in 10 CFR 50.75(f)(1):

The information in [the DFSJ report must include [...J the assumptions used regarding rates of escalation in decommissioning costs, rates of earnings on decommissioning funds, and rates of other factors used in funding projections.

Provide the citation (e.g., an Order by the rate-regulatory authority) by the regulatory entity that allows for the assumptions used regarding rates of escalation in decommissioning costs, rate of earnings on decommissioning funds and rates of other factors assumed in the submitted DFS report for all ownersllicensees of BSEP, CR-3, HNP and HBRESP.

- 2 Also, provide the breakdown, if applicable, for each co-owner, of the co-owner's trust fund divided between the amount allowed at a higher earnings rate and the amount at the lower earnings rate (e.g. provide the portion of the accumulated trust fund amount of the City of Leesburg that has an assumed earnings rate of 7.422 percent through 2016).

RAI-2: Schedule of annual amounts remaining to be collected In its March 31, 2011, DFS report for BESP, HNP and HBRESP, the licensee provided the rate of earnings on decommissioning funds divided by qualified and nonqualified for North Carolina and all other contributions, the annual amounts remaining to be collected divided by North Carolina and South Carolina, but did not provide a breakdown for the annual amount remains to be collected between the qualified and nonqualified fund for North Carolina.

As stated in 10 CFR 50.75(f)(1):

The information in [the DFSJ report must include [...J a schedule of the annual amounts remaining to be collected....

Provide the annual payments, by year, divided between the amounts allocated to the North Carolina qualified fund and the North Carolina nonqualified fund.

RAI-3: Amounts accumulated In its March 31, 2011, report, licensees did not state if the amount of decommissioning funds accumulated was an after-tax amount.

The provisions of 10 CFR 50.7 5(f)( 1) and (2) require the licensee to report the amount of funds accumulated to the end of the calendar year preceding the report.

Provide the after-tax amount of funds accumulated through December 31, 2010.
