COMPLETION OF THE U. S. NUCLEAR REGULAORY COMMISSION (NRC)

REVIEW OF CONFIRMATORY ORDER EA-09-060

Dear Mr. Kirwin:

The purpose of this letter is to acknowledge the completion of our review of the actions required in response to the Confirmatory Order issued to you by the NRC on November 10, 2009.

Through your correspondence, the NRC was kept informed of your completion of required actions in compliance with the timelines established in the Confirmatory Order. We independently reviewed the information you provided and determined that your actions were in compliance with the requirements delineated in the Confirmatory Order.

Following your completion of the required actions associated with the Confirmatory Order, the NRC conducted inspection activities at the corporate level and at a cross-section of your nuclear power plants, including sites from NRC Region I, Region III, and Region IV. These inspections consisted of an independent review of your implementation of corrective action(s) and verified your compliance with the order requirements. The results of these inspections are documented in Section 4OA5 of the following NRC inspection reports: Palisades Nuclear Plant Integrated Inspection Report 05000255/2010005, dated February 8, 2011; Indian Point Nuclear Generating Unit 3 - NRC Integrated Inspection Report 05000286/2010005, dated February 11, 2011; and, Arkansas Nuclear One - NRC Integrated Inspection Report 05000313/2010005 and 05000368/2010005, dated February 14, 2011.

The NRC has no further questions on this issue.
