RE: Verification of DOE ownership of Fuel Good day all, Below is the list of facilities covered under the DOE NE Research Reactor Infrastructure program. The government facilities are not included under this program; however, I am working to understand what arrangements, and with whom within DOE, cover them.

Subject:

Verification of DOE ownership of Fuel

Dear Mr. Wade,

My name is Paul Doyle and I work for the U.S. Nuclear Regulatory Commission. I have been tasked with renewing the license for two research and test reactors. Specifically the AGN-201M reactor at Texas A&M University Reactor and the AGN-201M reactor at the University of New Mexico. You could help me greatly in this pursuit.

I have attached to this email a copy of a 1983 letter from Robert L. Morgan (DOE) to Harold Denton (NRC) regarding ownership of the fuel at University Reactors. The second and third paragraphs of the letter state:

Generally, universities or other Government agencies operating research reactors have existing agreements with the Department whereby DOE provides, through fuel assistance contracts the funds to purchase the fuel. In such cases the Department retains title to that fuel and is obligated to take the SNF and/or HEU generated by these reactors for storage or reprocessing at no cost to the research reactor organizations.

Accordingly, the Department of Energy has determined that owners of research reactors who are university or Government entities and have entered into such contracts with DOE, do not need further nuclear waste disposal contracts with the Department as specified under the provisions of Section 302(B}(2) of the Nuclear Waste Policy Act of 1982.

Unfortunately the letter does not specify which universities have entered into agreements with DOE. If you could provide a letter to my branch chief verifying that DOE retains ownership of the fuel for the below listed reactors, it would greatly help our effort in renewing these licenses.

The address of my branch chief is:
