UNIVERSITY OF NEW MEXICO, DETERMINATION OF ACCEPTABILITY AND SUFFICIENCY FOR DOCKETING AND OPPORTUNITY FOR A HEARING REGARDING THE APPLICATION FOR RENEWAL OF FACILITY LICENSE NO.

R-102 FOR THE AGN-201M REACTOR (TAC NO. ME1590)

Dear Dr. Busch:

By letter dated February 21, 2007, as supplemented by letter dated November 9, 2009, the University of New Mexico (UNM) submitted an application to the U. S. Nuclear Regulatory Commission (NRC) for renewal of Facility Operating License No. R-102 for the AGN-201M Reactor.

Based on initial review of the application, the NRC staff determined that UNM submitted sufficient information such that the application is acceptable for docketing in accordance with Title 10 of the Code of Federal Regulations (CFR) Section 50.33 and 50.34. However, the NRC staffs determination does not preclude requests for additional information as the review proceeds.

Enclosed is a copy of the Notice of Acceptance for Docketing and Opportunity for Hearing on the Application Regarding Renewal for an Additional 20-year Period for the University of New Mexico AGN-201M Research Reactor and Order Imposing Procedures for Access to Safeguards Information and Sensitive Unclassified Non-Safeguards Information being sent to the Office of the Federal Register for publication. The notice provides the opportunity to request a hearing and to file a petition for leave to intervene.
