ACCEPTANCE REVIEW OF LICENSING ACTION RE: TRANSITION FROM WESTINGHOUSE TO AREVA NUCLEAR FUEL - CALVERT CLIFFS NUCLEAR POWER PLANT, UNIT NOS. 1 AND 2 (TAC NOS. ME2831 AND ME2832)

Dear Mr. Gellrich:

By letter dated November 23, 2009, Calvert Cliffs Nuclear Power Plant, LLC (the licensee) submitted a license amendment request for the Calvert Cliffs Nuclear Power Plant, Unit Nos. 1 and 2. The proposed amendment request would modify the licensing basis and Technical Specifications to allow the use of AREVA Advanced CE-14 HTP fuel.

On January 7, 2010, the Nuclear Regulatory Commission (NRC) staff held a conference call with members of your staff to discuss deficiencies identified during the acceptance review of the amendment request. Specifically, the amendment request did not adequately identify and disposition safety evaluation limitations and conditions on the 15 AREVA topical reports being incorporated in the reference list of the Core Operating Limits Report. By letter dated January 11, 2010, you were informed of the above deficiencies. In addition, you were informed that the license amendment request would need to be supplemented by January 27,2010.

By letter dated January 26, 2010, supplemental information was submitted. The NRC staff has reviewed the supplemental information and concludes that it provides technical information in sufficient detail to enable the staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment.

You will be advised of any further information needed to support the staff's detailed technical review by separate correspondence.
