PPL Susquehanna, Units 1 and 2. - ACCEPTANCE OF REQUESTED LICENSING ACTION RE:

Exemption to Extend Part 73 Implementation Date (TAC NOS. ME2839 and ME2840)

By letter dated December 3, 2009, as supplemented by Letter dated January 8, 2010, you submitted an exemption request for extension of implementation date physical security plans for certain requirements of 10 CFR Part 73 issued by NRC in a Final Rule dated March 27, 2009 (74 FR13926). The purpose of this communication is to provide the results of the NRC staff=s acceptance review of this amendment request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.

Section 73.5 of Title 10 of the Code of Federal Regulations (10 CFR) states, in part, that the Commission may grant exemptions which are authorized by law, will not present an undue risk to public health and safety, is consistent with common defense and security, special circumstances are present, and are otherwise in the public interest.

The NRC staff in NSIR/DSP/RSRLB have reviewed your application and concluded that it does provide information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed amendment in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
