By letter dated June 1, 2009, Entergy Operations, Inc. (Entergy), submitted requests relief from the requirements of the American Society of Mechanical Engineers (ASME), Boiler and Pressure Vessel (B&PV) Code,Section XI pertaining to volumetric, surface, and visual examinations at Waterford Steam Electric Station, Unit 3, Request for Relief WF3-ISI-007, WF3-ISI-008, WF3-ISI-009, WF3-ISI-010, WF3-ISI-011, WF3-ISI-012 WF3-ISI-013, WF3-ISI-014.
These requests cover the examination of welds in several locations, where the required coverage cannot be obtained due to interference or geometry. These reliefs are for the second 10-year interval.
These 6 RRs are covered by TAC Nos. ME1426, ME1427, ME1428, ME1429, ME1430, ME1431, ME1432, and ME1433.
The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of the relief requests. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Pursuant to 10 CFR 50.55a(g)(6)(i), of Title 10 of the Code of Federal Regulations (10 CFR), the Commission will evaluate determinations under paragraph (g)(5) of this section that Code requirements are impractical. The Commission may grant such relief and may impose such alternative requirements as it determines is authorized by law and will not endanger life or property or the common defense and security and is otherwise in the public interest giving due consideration to the burden upon the licensee that could result if the requirements were imposed on the facility.
The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the staff to proceed with its detailed technical review and make an independent assessment regarding the acceptability of the proposed relief requests in terms of regulatory requirements and the protection of public health and safety and the environment. If additional information is needed for the staff to complete its technical review, you will be advised by separate correspondence.
