- Bill, The package (ADAMS Accession # ML083250250) has been reviewed by the NRC staff, in accordance with LIC-109, and is found to be acceptable to begin in-depth technical review, i.e.,
all critical elements are addressed. However, it was noted that the licensee apparently has used a version of NEI 99-01, that was not endorsed, in the development of its Emergency Action Levels (EALs). NEI had sent out multiple draft versions of NEI 99-01 to the industry for comment, and this seems to have elements of one of those draft versions. The NRC has endorsed NEI 99-01 Revision 5, dated February 2008, as captured in ADAMS via ML080450149. In our opinion what the application is close enough to be accepted for review.
However, the RAI process will ensure compliance with the endorsed EAL scheme.
