August 4, 2008 OFFICE OF NUCLEAR REACTOR REGULATION NOTIFICATION OF SIGNIFICANT LICENSING ACTION LICENSEE: Dominion Nuclear Connecticut, Incorporated Millstone Power Station, Unit 3 Docket No. 50-423

SUBJECT:

PROPOSED ISSUANCE OF A FINAL NO SIGNIFICANT HAZARDS CONSIDERATION DETERMINATION AND LICENSE AMENDMENT FOR A STRETCH POWER UPRATE FOR WHICH A HEARING HAS BEEN REQUESTED This is to inform the Commission that a final no significant hazards consideration determination and license amendment will be issued on or about August 15, 2008, to Dominion Nuclear Connecticut, Incorporated. This action is being taken in response to the licensees amendment application dated July 13, 2007,1 as supplemented by additional letters,2 and will modify Facility Operating License No. NPF-49 for Millstone Power Station, Unit 3, with a stretch power uprate amendment. The license amendment will allow an increase in the maximum authorized power level from the current licensed thermal power level of 3,411 megawatts thermal (MWt) to 3,650 MWt, and make changes to the facility operating license and technical specifications, as necessary, to support operation at the stretch power level, which is an increase of approximately 7 percent.

A hearing on the license amendment was requested by Connecticut Coalition Against Millstone (CCAM) and Nancy Burton on March 17, 2008.3 The Atomic Safety and Licensing Board (ASLB) issued an Order dated June 4, 2008.4 The ASLB Order denied CCAM and Nancy Burtons request for an evidentiary hearing. On June 16, 2008,5 CCAM and Nancy Burton filed an appeal to the Commission regarding the ASLB Order.

The State of Connecticut will be notified.
