MILLSTONE POWER STATION UNIT 3 LICENSE AMENDMENT REQUEST STRETCH POWER UPRATE Pursuant to 10 CFR 50.90, Dominion Nuclear Connecticut, Inc. (DNC) hereby requests an amendment to Operating License NPF-49 for Millstone Power Station Unit 3 (MPS3). This proposed Stretch Power Uprate (SPU) License Amendment Request (LAR) would increase the unit's authorized core power level from 3411 megawatts thermal (MWt) to 3650 MWt, and make changes to Technical Specifications as necessary to support operation at the stretch power level.

DNC developed this LAR utilizing the guidelines in NRC Review Standard, RS-001, "Review Standard for Extended Power Uprates." In addition, requests for additional information (RAIs) regarding SPU and Extended Power Uprate (EPU) applications for other nuclear units were reviewed for applicability. Information that addresses many of those RAIls is included in this MPS3 SPU LAR.

RS-001 states that a SPU is characterized by power level increases up to 7 percent and does not generally involve major modifications. Plant modifications are addressed in Section 1.0 of the License Report (LR) (Attachment 5) and are not considered to be major. Since the requested uprate is 7 percent and does not involve major plant modifications, it is considered to be a SPU.

Information provided in the Attachments to this letter are summarized as follows:

Attachment 1 provides Description, Technical Analysis and Regulatory Analysis for the proposed Operating License and Technical Specifications changes. Also provided is a description of the License Basis Changes that require NRC review and approval as part of the SPU. As discussed in this attachment, the proposed amendment does not involve a significant hazards consideration pursuant to the provisions of 10 CFR 50.92. The Site Operations Review Committee has reviewed and concurred with this determination.

  • Attachment 2 provides a Supplemental Environmental Report. This report contains an assessment of potential environmental impacts from the proposed increase in core power level from 3411 MWt to 3650 MWt.

" Attachment 3 provides marked-up pages to reflect the proposed changes to the Operating License and Technical Specifications.

" Attachment 4 provides the associated changes to the Technical Specifications Bases. These changes are provided for information only.

Following approval of the requested Operating License and Technical Specifications changes, the Technical Specifications Bases will be formally revised in accordance with the Bases control program.

  • Attachment 5 provides the SPU LR, formatted in accordance with RS-001.

For plant design features and analyses affected by the SPU, the LR describes MPS3 Current Licensing Basis (CLB) and methods, margins, or operating limits, and results of the investigations that have been performed to determine the impacts of SPU on the MPS3 CLB. This LR demonstrates acceptable facility operation at the increased power level.

" Attachment 6 contains Westinghouse letter CAW-07-2296, "Application for Withholding Proprietary Information from Public Disclosure," dated June 25, 2007, which requests the withholding of Attachment 7. This attachment also includes the accompanying affidavit, Proprietary Information Notice, and Copyright Notice.

" Attachment 7 contains Westinghouse document NEU-07-128P, "Millstone Nuclear Power Station Unit 3, Stretch Power Uprate Program, Supplemental Information," dated June 25, 2007, which is proprietary information. contains information proprietary to Westinghouse Electric Company LLC, and is supported by an affidavit provided in Attachment 6 that is signed by Westinghouse, the owner of the information. The affidavit sets. forth the basis on which the information may be withheld from public disclosure by the Commission and addresses with specificity the considerations listed in 10 CFR 2.390(b)(4). Accordingly, it is respectfully requested that the information which is proprietary to Westinghouse be withheld from public disclosure in accordance with 10 CFR 2.390(a)(4).

Correspondence with respect to the copyright or proprietary aspects of the items listed above or the supporting Westinghouse Affidavit should reference Westinghouse letter CAW-07-2296 and should be addressed to Mr. J. A. Gresham, Manager, Regulatory Compliance and Plant Licensing,

DNC requests approval of this proposed amendment by June 30, 2008, with the amendment effective as of the date of issuance and implementation to be completed within 12 months of issuance. Approval by June 30, 2008 will support the refueling outage currently scheduled to begin in the fall of 2008.

In accordance with 10 CFR 50.91(b), a copy of this license amendment request is being provided to the State of Connecticut.
