ACCEPTANCE REVIEW RESULTS RE: REQUEST FOR APPROVAL OF TRANSFER OF FACILITY OPERATING LICENSES AND CONFORMING AMENDMENTS - CLINTON POWER STATION, UNIT NO. 1; OYSTER CREEK NUCLEAR GENERATING STATION; AND THREE MILE ISLAND NUCLEAR STATION, UNIT 1 (TAC NOS. MD9012, MD9013, AND MD9014)
Dear Mr. Pardee:
By letter dated June 20, 2008, Exelon Generation Company, LLC (Exelon Generation), and AmerGen Energy Company, LLC (AmerGen), submitted an application under Title 10 of the Code of Federal Regulations (10 CFR), Section 50.80, requesting consent to the transfer of the operating licenses for Clinton Power Station, Unit No. 1, Oyster Creek Nuclear Generating Station, and Three Mile Island Nuclear Station, Unit 1, from AmerGen to Exelon Generation.
The application also requests, pursuant to 10 CFR 50.90, conforming amendments to Operating License Nos. NPF-62, DPR-16, and DPR-50 to reflect Exelon Generation as the owner and operator of Clinton Power Station, Unit No. 1, Oyster Creek Nuclear Generating Station, and Three Mile Island Nuclear Station, Unit 1, respectively.
The purpose of this letter is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staff=s acceptance review of this application. The acceptance review was performed to determine if there was sufficient technical information to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the plant.
Consistent with 10 CFR 50.90, an amendment to the license (including the technical specifications) must fully describe the changes requested, and following as far as applicable, the form prescribed for original applications. Consistent with 10 CFR 50.80, applicants for license transfer shall include as much of the information described in 10 CFR 50.33 and 10 CFR 50.34 with respect to the identity and technical and financial qualifications as would be required by those sections if the application were for an initial license.
The NRC staff has reviewed your application and concluded that it does provide the technical and financial information in sufficient detail to enable the staff to proceed with its detailed review and make an independent assessment regarding the acceptability of the proposed licensing actions in terms of regulatory requirements and the protection of public health and safety and
