SOUTH TEXAS PROJECT, UNITS 1 AND 2 - APPROVAL OF EXTENSION FOR 3-MONTH RESPONSE TO GENERIC LETTER 2008-01, MANAGING GAS ACCUMULATION IN EMERGENCY CORE COOLING, DECAY HEAT REMOVAL, AND CONTAINMENT SPRAY SYSTEMS (TAC NOS. MD7881 AND MD7882)

Dear Mr. Halpin:

Generic Letter (GL) 2008-01, Managing Gas Accumulation In Emergency Core Cooling, Decay Heat Removal, And Containment Spray Systems, was issued by the Nuclear Regulatory Commission (NRC) on January 11, 2008 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML072910759). In GL 2008-01, the NRC requested licensees to submit information to demonstrate that the emergency core cooling, decay heat removal, and containment spray systems are in compliance with the applicable regulatory requirements, and that suitable design, operational, and testing control measures are in place for maintaining this compliance. The GL 2008-01 states that each licensee is requested to submit a written response within 9 months to provide requested information and that if a licensee cannot meet the requested 9-month response date, a 3-month written response is required that describes the licensees proposed alternative course of action, including the basis for the acceptability of the proposed alternative course of action. The 3-month response was due April 11, 2008.

By letter dated April 9, 2008 (ADAMS Accession No. ML081050250), STP Nuclear Operating Company (STPNOC, the licensee) stated that because of the outage schedules for South Texas Project (STP), Units 1 and 2, the licensee would be unable to complete the necessary assessments to fully respond to GL 2008-01 by the requested 9-month date (October 11, 2008).

GL 2008-01 included provisions for a 3-month response if a licensee could not provide the information requested in the 9-month response. In a phone call with your staff on April 3, 2008, Mr. J. Wermiel (NRC) agreed that the 3-month response for STPNOC could be deferred to May 12, 2008. The additional time for the 3-month letter allowed STPNOC to perform some of the GL 2008-01 evaluations required for Unit 1 during its spring outage, better define the remaining Unit 1 evaluation scope, and prepare and submit the response after the Unit 1 outage.

This letter is to formally acknowledge the approval of the requested extension to the due date for submitting the 3-month response to GL 2008-01 and to document the telephone call with the NRC staff. Specifically, you requested an extension for providing the above 3-month response from April 11, 2008, to May 12, 2008, at STP, Units 1 and 2. The NRC staff finds that your justification to extend the due date for the 3-month written response to GL 2008-01 to May 12, 2008, is acceptable for granting your extension request. By letter dated May 12, 2008 (ADAMS

Accession No. ML081400721), you submitted a 3-month response to GL 2008-01 for STP, Units 1 and 2. The NRC staff will evaluate your alternate plans (3-month response) for responding to GL 2008-01 and will respond appropriately.
