REQUEST FOR ADDITIONAL INFORMATION MISSOURI UNIVERSITY OF SCIENCE AND TECHNOLOGY DOCKET NO. 50 -123

1. Section 13.1.1. This Section, Maximum Hypothetical Accident (MHA) - Failure of a Fueled Experiment, states, The resulting whole-body dose associated with the 100 watt fueled experiment was 242 mrem; the whole-body dose was lower by about two magnitudes for the 1 W case. This dose is a factor of two lower than the 10 CFR Part 20 annual limit of 500 mrem exposure to individuals in unrestricted areas.

Provide the specific section of 10 CFR Part 20 in the above reference statement (i.e., the 10 CFR Part 20 annual limit of 500 mrem exposure to individuals in unrestricted areas). If 10 CFR Part 20.1301(d) is used in the above reference statement, please (i) provide demonstration of the need for, the frequency, and the expected duration of operations in the 100 watt fuel experiment; (ii) provide the licensees program to assess and control dose within the 500 mrem annual limit; and (iii) the procedure to be followed to maintain the dose as low as is reasonably achievable (ALARA).

Provide the MHA dose associated with the 1 watt fuel experiment. If the dose received by individuals in unrestricted areas does exceed 100 mrem, provide justification in the above paragraphs (i) and (ii).

Alternatively, demonstrate that the TEDE to individual members of the public from licensed operation does not exceed 100 mrem in a year per 10 CFR Part 20.1301(a)(1) for both the 100 W and 1 W fueled experiment. Provide the analysis, or limiting conditions of fuel experiment to ensure that the proposed MHA dose does not exceed 100 mrem to individual members of the public. Also, provide justification why the current analysis differs from the previous one.

2. In accordance with 10 CFR Part 50.33(f), the staffs analysis to determine whether the applicant is financially qualified to operate the reactor facility will include a review of the applicants latest financial statements. Since this information is not included in the application, please provide a copy of the latest financial statements of the Missouri University of Science and Technology.
3. The application, dated August 30, 2004, states that the 1990 cost estimate to decommission the reactor has been updated annually by using the methodology described in NUREG-1307, which referenced a 1990 decommissioning cost of $0.816 million and an updated estimate cost of $1.925 million in 2005 dollars. In accordance with 10 CFR 50.75(d) and 50.33(k),

please update the application to include the following:

a) Provide a current cost estimate for decommissioning the MST reactor (in 2008 dollars);

b) Indicate which method or methods described in paragraph (e) of 10 CFR Part 50.75 as acceptable to the NRC will be used to provide funds for decommissioning; and c) Provide a description of the means of adjusting the future cost estimate and associated funding level that will be used over the life of the facility.
