In accordance with 10 CFR 50.90, Carolina Power and Light Company, doing business as Progress Energy Carolinas, Inc., submitted the above License Amendment Request for the Harris Nuclear Plant (HINP) (Reference 1). In that request, dated June 15, 2007, the "Inservice Testing Program" and "Technical Specifications (TS) Bases Control Program" were incorrectly designated as sections 6.8.4.1 and 6.8.4.m, respectively, on pages 6-19d and 6-19e of the, , "Revised Technical Specification (TS) Pages".

This transmittal provides the new pages with the correct identification sequences, 6.8.4.m

("Inservice Testing Program") and 6.8.4.n ("Technical Specification (TS) Bases Control Program"). Please note that the changes in page numbers from 6-19d to 6-19g ("Inservice Testing Program") and from 6-19e to 6-19h ("Technical Specification (TS) Bases Control Program") are due to the incorporation of TS pages from the recent implementation of Amendment No. 124.

Subsequent to the submittal of this License Amendment Request (LAR), the Nuclear Regulatory C6immission provided industry feedback noting that plant specific adoption of TSTF-479 would require the addition of a caveat that Surveillance Requirement (SR) 3.0.2 (HNP's SR 4.0.2) only apply to Frequencies in the IST Program of 2 years or less. This caveat was included in TSTF-497, Revision 0, "Limit Inservice Testing Program Application to Frequencies of 2 Years or Less," as approved by the NRC (Reference 2).

HNP-08-019 Page 2 Therefore, this supplement to the original June 15, 2007, LAR proposes that this clarified terminology in TSTF-497, Revision 0 be incorporated into HNP's TS 6.8.4.m.

Carolina Power and Light Company, doing business as Progress Energy Carolinas, Inc., has determined that this supplemental LAR does not change the conclusions from the original submittal that there are no significant hazards considerations. Additionally, categorical exclusion from the environmental review pursuant to the provision to 10 CFR 51.22(c)(9) remains appropriate.

In accordance with 10 CFR 50.91(b), a copy of this application, with attachments, is being provided to the designated representative for the State of North Carolina.

No new regulatory commitments are made as part of this document.

m. Inservice Testina Proaram This program provides controls for inservice testing of ASME Code Class 1, 2, and 3 components. The program shall include the following:
1. Testing frequencies specified in the ASME Code for Operation and Maintenance of Nuclear Power Plants and applicable Addenda as follows:

2. The provisions of SR 4.0.2 are applicable to the above required Frequencies and to other normal and accelerated Frequencies specified as 2 years of less in the Inservice Testing Program for performing inservice testing activities,
3. The provisions of SR 4.0.3 are applicable to inservice testing activities, and
4. Nothing in the ASME Code for Operation and Maintenance of Nuclear Power Plants shall be construed to supersede the requirements of any Technical Specification.

n. Technical Specifications (TS) Bases Control Program This program provides a means for processing changes to the Bases of these Technical Specificationsi
1. Changes to the Bases of the TS shall be made under appropriate administrative controls and reviews.
2. Licensees may make changes to Bases without prior NRC approval provided the changes do not require either of the following:
a. A change in the TS incorporated in the license, or
b. A change to the FSAR or Bases that requires NRC approval pursuant to 10 CFR 50.59.
3. The Bases Control Program shall contain provisions to ensure that the Bases are maintained consistent with the FSAR.
4. Proposed changes that meet the criteria of Specification 6.8.4.n.2 above shall be reviewed and approved by the NRC prior to implementation. Changes to the Bases implemented without prior NRC approval shall be provided to the NRC on a frequency consistent with 10 CFR 50.71(e).
