SUBJECT:

BEAVER VALLEY POWER STATION, UNIT NO. 1 - CLOSURE OF CONFIRMATORY ACTION LETTER NRR-07-011 (TAC NO. MD4132)

Dear Mr. Sena:

On March 20, 2007, the U.S. Nuclear Regulatory Commission (NRC) issued Confirmatory Action Letter (CAL) No. NRR-07-011 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML070780503) regarding dissimilar metal welds in the pressurizer at Beaver Valley Power Station, Unit No. 1 (BVPS-1). This letter acknowledges receipt of your letter dated January 11, 2008 (ADAMS Accession No. ML080160297) informing the NRC of actions taken in response to this CAL.

In your letter, you stated that during the fall 2007 refueling outage at BVPS-1, FirstEnergy Nuclear Operating Company (FENOC) completed the mitigation activities and required inspections as stated in Commitment No. 1 of FENOC Letter L-07-031 (ADAMS Accession No. ML070640092). FENOC completed the planned pressurizer structural weld overlay work scope, which included the application of structural weld overlays to the pressurizer spray nozzle, relief nozzle, and three safety nozzles. Following the application of the overlays, ultrasonic examinations were performed using techniques and personnel qualified in accordance with the Electric Power Research Institute Performance Demonstration Initiative protocol. The final weld overlay ultrasonic examinations were completed on October 15, 2007, with no recordable indications identified in any of the weld overlays or required underlying base material.

Based on your letter, the NRC has found that all the commitments listed in the CAL and supporting commitment letter (ADAMS Accession No. ML070640092) have been met. No further response is required regarding the CAL. We consider the CAL closed. As such, it is no longer necessary to implement enhanced inspection and leakage monitoring requirements for the reactor coolant system. This action closes TAC No. MD4132.

Thank you for informing us of the actions documented in your letter. These actions may be examined during a future NRC inspection of your facility.

Current NRC guidance regarding CALs is contained in the NRC Enforcement Policy and the NRC Enforcement Manual, which are available at the NRC web site at http://www.nrc.gov/about-nrc/regulatory/enforcement.html (click on Enforcement Policy or Enforcement Guidance) or by contacting the Government Printing Office (GPO) toll-free at 1-888-293-6498. The GPO is open from 7:00 a.m. to 9:00 p.m. EST, Monday through Friday (except Federal holidays).

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter and your response will be made available electronically for public inspection in the NRC Public Document Room or from the NRC=s document system (ADAMS), accessible from the NRC Web site at http://www.nrc.gov/reading-rm.html.

Sincerely,

/RA/
