LICENSE AMENDMENT REQUEST (LAR)07-004, REVISION TO THE OPERATING LICENSE AND TECHNICAL SPECIFICATION 1.0, USE AND APPLICATION AND 3.7.17, SPENT FUEL ASSEMBLY STORAGE TO REVISE RATED THERMAL POWER FROM 3458 MWT TO 3612 MWT (TAC NOS. MD6615 AND MD6616)

Dear Mr. Blevins:

By application dated August 28, 2007, TXU Generation Company LP (the licensee, subsequently renamed Luminant Generation Company LLC) requested changes to the license and Technical Specifications (TSs) for Comanche Peak Steam Electric Station, Units 1 and 2.

The proposed changes would (1) increase the rated thermal power from 3458 megawatts thermal (MWt) to 3612 MWt (stretch power uprate) and (2) provide revisions to TS 3.7.17, Spent Fuel Assembly Storage, based on the new spent fuel pool (SFP) criticality analysis for the proposed stretch power uprate (SPU).

In order to meet your proposed SPU implementation schedule, the Nuclear Regulatory Commission (NRC) staff intends to complete its review of your application in two parts. The first part will address the proposed SPU, and the second part will address the new SFP criticality analysis. The staff intends to complete its review of the proposed SPU by July 31, 2008, followed by completion of its review of the new SFP criticality analysis by September 30, 2008.

The proposed staff schedule was discussed with Mr. J. Seawright of your staff on October 17, 2007.

Please confirm by letter within 30 days of the date of this letter if the staffs proposed review schedule will adequately support your implementation of the SPU. In addition, please describe any changes you propose to implement to control spent fuel storage until the NRC staff has reviewed and approved the new SFP criticality analysis for the proposed SPU.
