COMMITMENTS RELATED TO EXTENDED POWER UPRATE OPERATIONS; QUAD CITIES, UNITS 1 AND 2 (TAC NOS. MC4397 AND MC4398)

Dear Mr. Crane:

By letter dated November 18, 2005, Exelon Generation Company, LLC (Exelon) provided a revision to its commitments related to the operation of Quad Cities, Units 1 and 2 at extended power uprate (EPU) conditions. In particular, Exelon identified specific activities and schedules regarding evaluation of the performance of the steam dryers for each unit. The November 18, 2005, letter references 10 previously submitted letters from Exelon containing a number of commitments, many of which have been satisfied concerning assessment Quad Cities EPU operation.

Item 6 attached to the November 18, 2005, letter specifies that a management meeting will be held by December 15, 2005, during which Exelon will discuss the results and conclusions of evaluations performed to support EPU operation at Quad Cities. The statement further indicates that if NRC management is not satisfied with Exelon's conclusions and evaluations, Exelon would voluntarily return the affected unit(s) to pre-EPU power levels if it is unable to resolve the concerns within 14 days. If no concerns are identified during the management meeting under commitment 6, Exelon would formally request NRC acceptance of continuous EPU operation of the Quad Cities units by December 30, 2005.

A technical meeting between the NRC and Exelon staffs was held on November 8 and 9, 2005, to discuss the remaining EPU/steam dryer performance issues. At the end of the meeting, 10 open items remained. The NRC and Exelon staffs agreed that additional information would be provided by Exelon, and discussed via telephone conference calls prior to holding the management meeting. On December 20, 2005, Exelon completed transmittal of the information it believes adequately responds to the open items. The NRC will forward the information to its support contractors. However, the NRC staff has had difficulties in securing the committed technical support needed for review of the submitted material. As a result, the NRC and Exelon staffs have determined that deferral of the management meeting to close out the evaluation of Quad Cities EPU/steam dryer performance is necessary. Based on its review to date, the NRC staff does not consider this short delay to raise concerns regarding the continued structural integrity of the steam dryers at Quad Cities.

C. Crane Upon receipt and evaluation of all of the material related to the 10 open items, the NRC and Exelon staffs will resolve any technical issues via a telephone conference call(s) and mutually agree on an acceptable date for the management meeting.
