ISSUANCE OF RENEWED FACILITY OPERATING LICENSE NOS. DPR-67 AND NPF-16 FOR ST. LUCIE PLANT, UNIT NOS. 1 AND 2

Dear Mr. Stall:

The U.S. Nuclear Regulatory Commission (NRC) has issued Renewed Facility Operating License Nos. DPR-67 and NPF-16 for the St. Lucie Plant, Unit Nos. 1 and 2 (St. Lucie, Units 1 and 2), respectively. These renewed facility operating licenses have been issued on the basis of our review of your applications dated November 29, 2001, as supplemented by letters dated January 8, June 25, August 26, September 26 (four letters), October 3, October 10, November 27, December 23, 2002, and January 9, February 4, March 27 (two letters),

March 28, April 25, May 30, June 10, and June 23, 2003. The Technical Specifications for St. Lucie, Units 1 and 2, were not amended as a result of our review. contains Renewed Facility Operating License No. DPR-67 with two attachments (Appendix A, Technical Specifications, and Appendix B, Environmental Protection Plan (Non-Radiological)). Enclosure 2 contains Renewed Facility Operating License No. NPF-16 with four attachments (Appendix A, Technical Specifications, Appendix B, Environmental Protection Plan (Non-Radiological), Appendix C, Antitrust Conditions, and Appendix D, Antitrust Conditions).

Renewed Facility Operating License No. DPR-67 (the renewed license for St. Lucie, Unit 1) expires at midnight, March 1, 2036. Renewed Facility Operating License No. NPF-16 (the renewed license for St. Lucie, Unit 2) expires at midnight, April 6, 2043.

The technical basis for issuing the renewed licenses is set forth in NUREG-1779, Safety Evaluation Report Related to the License Renewal of St. Lucie Nuclear Plant, Units 1 and 2, dated September, 2003. The results of the environmental reviews related to the issuance of the renewed licenses are contained in NUREG-1437, Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 11, Regarding St. Lucie Units 1 and 2," dated May 19, 2003.

FLORIDA POWER AND LIGHT COMPANY DOCKET NO. 50-335 ST. LUCIE PLANT UNIT NO. 1 RENEWED FACILITY OPERATING LICENSE NO. DPR-67 The U.S. Nuclear Regulatory Commission (the Commission) having previously made the findings set forth in License No. DPR-67 issued March 1, 1976, has now found that:

a. The application to renew License No. DPR-67 filed by the Florida Power and Light Company (FPL or the licensee), complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions rules and regulations set forth in 10 CFR Chapter 1, and all required notifications to other agencies or bodies have been duly made;
b. Actions have been identified and have been or will be taken with respect to (1) managing the effects of aging during the period of extended operation on the functionality of structures and components that have been identified to require review under 10 CFR 54.21(a)(1), and (2) time-limited aging analyses that have been identified to require review under 10 CFR 54.21(c), such that there is reasonable assurance that the activities authorized by this renewed license will continue to be conducted in accordance with the current licensing basis, as defined in 10 CFR 54.3, for St. Lucie Plant Unit No.1, and that any changes made to the plants current licensing basis in order to comply with 10 CFR 54.29(a) are in accord with the Act and the Commissions regulations;
c. The facility will operate in conformity with the application, as amended, the provisions of the Act, and the rules and regulations of the Commission;
d. There is reasonable assurance: (i) that the activities authorized by this renewed operating license can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the rules and regulations of the Commission;
e. FPL is technically and financially qualified to engage in the activities authorized by this renewed operating license in accordance with the rules and regulations of the Commission;
f. FPL has satisfied the applicable provisions of 10 CFR Part 140, Financial Protection Requirements and Indemnity Agreements, of the Commissions regulations;
g. The renewal of this operating license will not be inimical to the common defense and security or to the health and safety of the public; and
h. After weighing the environmental, economic, technical, and other benefits of the facility against environmental and other costs and considering available alternatives, the Renewed License No. DPR-67 Enclosure 1

issuance of Renewed Facility Operating License No. DPR-67, subject to the conditions for protection of the environment set forth herein, is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.

On the basis of the foregoing findings regarding this facility, Facility Operating License No. DPR-67, issued March 1, 1976, is superseded by Renewed Facility Operating License No. DPR-67, which is hereby issued to FPL to read as follows:

1. This renewed license applies to the St. Lucie Plant, Unit No. 1, a pressurized water nuclear reactor, and associated steam generators and electrical generating equipment (the facility). The facility is located on the licensees site on Huchinson Island in St. Lucie County, Florida, and is described in the Updated Final Safety Analysis Report, as supplemented and amended, and the Environmental Report, as supplemented and amended.
2. Subject to the conditions and requirements incorporated herein, the Commission hereby licenses FPL:

A. Pursuant to Section 104b of the Act and 10 CFR Part 50, "Licensing of Production and Utilization Facilities," to possess, use, and operate the facility as a utilization facility at the designated location on the St. Lucie site in accordance with the procedures and limitations set forth in this renewed license; B. Pursuant to the Act and 10 CFR Part 70, to receive, possess, and use at any time special nuclear material as reactor fuel, in accordance with the limitations for storage and amounts required for reactor operation, as described in the Final Safety Analysis Report as supplemented and amended; C. Pursuant to the Act and 10 CFR Parts 30, 40, and 70, to receive, possess, and use at any time any byproduct, source, and special nuclear material as sealed neutron sources for reactor startup, sealed sources for reactor instrumentation and radiation monitoring equipment calibration, and as fission detectors in amounts as required; D. Pursuant to the Act and 10 CFR Parts 30, 40, and 70, to receive, possess, and use in amounts as required any byproduct, source, or special nuclear material, without restriction to chemical or physical form, for sample analysis or instrument calibration or associated with radioactive apparatus or components; and E. Pursuant to the Act and 10 CFR Parts 30 and 70, to possess, but not separate, such byproduct and special nuclear materials as may be produced by the operation of the facility.

3. This renewed operating license shall be deemed to contain and is subject to the conditions specified in the following Commission regulations: 10 CFR Part 20, Section 30.34 of 10 CFR Part 30, Section 40.41 of 10 CFR Part 40, Sections 50.54 and 50.59 of 10 CFR Part 50, and Section 70.32 of 10 CFR Part 70; and is subject to all Renewed License No. DPR-67

applicable provisions of the Act and to the rules, regulations, and orders of the Commission now or hereafter in effect; and is subject to the additional conditions specified or incorporated below:

A. Maximum Power Level FPL is authorized to operate the facility at steady state reactor core power levels not in excess of 2700 megawatts (thermal).

B. Technical Specifications The Technical Specifications contained in Appendices A and B, as revised through Amendment No. 188 are hereby incorporated in the renewed license. FPL shall operate the facility in accordance with the Technical Specifications.

Appendix B, the Environmental Protection Plan (Non-Radiological), contains environmental conditions of the renewed license. If significant detrimental effects or evidence of irreversible damage are detected by the monitoring programs required by Appendix B of this license, FPL will provide the Commission with an analysis of the problem and plan of action to be taken subject to Commission approval to eliminate or significantly reduce the detrimental effects or damage.

C. Updated Final Safety Analysis Report The Updated Final Safety Analysis Report supplement submitted pursuant to 10 CFR 54.21(d), as revised on March 28, 2003, describes certain future activities to be completed before the period of extended operation. FPL shall complete these activities no later than March 1, 2016, and shall notifiy the NRC in writing when implementation of these activities is complete and can be verified by NRC inspection.

The Updated Final Safety Analysis Report supplement as revised on March 28, 2003, described above, shall be included in the next scheduled update to the Updated Final Safety Analysis Report required by 10 CFR 50.71(e)(4), following issuance of this renewed license. Until that update is complete, FPL may make changes to the programs described in such supplement without prior Commission approval, provided that FPL evaluates each such change pursuant to the criteria set forth in 10 CFR 50.59 and otherwise complies with the requirements in that section.

D. Sustained Core Uncovery Actions Procedural guidance shall be in place to instruct operators to implement actions that are designed to mitigate a small-break loss-of-coolant accident prior to a calculated time of sustained core uncovery.

E. Fire Protection FPL shall implement and maintain in effect all provisions of the approved fire protection program as described in the Updated Final Safety Analysis Report for the facility (The fire protection program and features were originally described in FPL submittals L-83-514 dated October 7, 1983, L-83-227 dated April 12, 1983, L-83-261 dated April 25, 1983, L-83-453 dated August 24, 1983, L-83-488 dated September 16, 1983, L-83-588 dated December 14, 1983, L-84-346 dated November 28, 1984, L-84-390 dated December 31, 1984, and L-85-71 dated February 21, 1985) and as approved by NRC letter dated July 17, 1984, and supplemented by NRC letters dated February 21, 1985, March 5, 1987, and October 4, 1988, subject to the following provision:

FPL may make changes to the approved fire protection program without prior approval of the Commission only if those changes would not adversely affect the ability to achieve and maintain safe shutdown in the event of a fire.

F. Physical Protection FPL shall fully implement and maintain in effect all provisions of the Commission-approved physical security, guard training and qualification, and safeguards contingency plans including amendments made pursuant to provisions of the Miscellaneous Amendments and Search Requirements revisions to 10 CFR 73.55 (51 FR 27817 and 27822) and the authority of 10 CFR 50.90 and 10 CFR 50.54(p). The plans, which contain Safeguards Information protected under 10 CFR 73.21, are entitled: St. Lucie Plant Security Plan, with revisions submitted through April 11, 1988; St. Lucie Plant Training and Qualification Plan, with revisions submitted through August 8, 1985; and St. Lucie Safeguard Contingency Plan, with revisions submitted through December 8, 1986. Changes made in accordance with 10 CFR 73.55 shall be implemented in accordance with the schedule set forth therein.

4. This renewed license is effective as of the date of issuance and shall expire at midnight on March 1, 2036.

a. The application to renew License No. NPF-16 filed by Florida Power & Light Company, Orlando Utilities Commission of the City of Orlando, Florida and Florida Municipal Power Agency (licensees) complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions regulations as set forth in 10 CFR Chapter 1 and all required notifications to other agencies or bodies have been duly made;
b. Pursuant to Section 103 of the Act and 10 CFR Part 50, Florida Power & Light Company, Orlando Utilities Commission of the City of Orlando, Florida and Florida Municipal Power Agency to possess, use, and operate the facility as a utilization facility at the designated location on the St. Lucie site in accordance with the procedures and limitations set forth in this renewed license; B. Pursuant to the Act and 10 CFR Part 70, FPL to receive, possess, and use at any time special nuclear material as reactor fuel, in accordance with the limitations for storage and amounts required for reactor operation, as described in the Final Safety Analysis Report, as supplemented and amended; C. Pursuant to the Act and 10 CFR Parts 30, 40, and 70, FPL to receive, possess, and use at any time byproduct, source, and special nuclear material as sealed 1

Before engaging in additional construction or operational activities which may result in a significant adverse environmental impact that was not evaluated or that is significantly greater than that evaluated in the Final Environmental Statement dated April 1982, FPL shall provide written notification to the Office of Nuclear Reactor Regulation.

H. FPL shall report any violations of the requirements contained in Section 3, Items A, D, F, and G of this license within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> by telephone and confirm by telegram, mailgram, or facsimile transmission to the NRC Regional Administrator, Region II, or his designee, no later than the first working day following the violation, with a written follow-up report within fourteen (14) days.

I. FPL shall notify the Commission, as soon as possible but not later than one hour, of any accident at this facility which could result in an unplanned release of quantities of fission products in excess of allowable limits for normal operation established by the Commission.

J. FPL shall have and maintain financial protection of such type and in such amounts as the Commission shall require in accordance with Section 170 of the Atomic Energy Act of 1954, as amended, to cover public liability claims.

4. This renewed license is effective as of the date of issuance, and shall expire at midnight April 6, 2043.

Renewed Facility Operating License No. NPF-16 authorizes operation of St. Lucie, Unit 2, by the licensee at reactor core power levels not in excess of 2700 megawatts thermal in accordance with the provisions of the St. Lucie, Unit 2, renewed license and its Technical Specifications.

St. Lucie, Units 1 and 2, are pressurized, light water moderated and cooled, nuclear reactors located on Hutchinson Island in St. Lucie County, Florida.

The applications for the renewed licenses complied with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions regulations. As Enclosure 3

required by the Act and the Commissions regulations in 10 CFR Chapter I, the Commission has made appropriate findings, which are set forth in each license. Prior public notice of the action involving the proposed issuance of these renewed licenses and of an opportunity for a hearing regarding the proposed issuance of these renewed licenses was published in the Federal Register on December 27, 2001 (66 FR 66946).
