SUMMARY

OF MEETING BETWEEN THE U.S. NUCLEAR REGULATORY COMMISSION STAFF AND EXELON GENERATION COMPANY, LLC TO DISCUSS A REQUEST FOR ADDITIONAL INFORMATION REGARDING THE QUAD CITIES NUCLEAR POWER STATION TRANSMISSION LINES (TAC NOS. MB6845 AND MB6846)

On June 17, 2003, the U.S. Nuclear Regulatory Commission (NRC) staff met with members of Exelon Generation Company, LLC (Exelon) in a public meeting in Rockville, Maryland to discuss a May 23, 2003, Request for Additional Information (RAI) for the Quad Cities Nuclear Power Station, Units 1 and 2 (QC). The RAI was issued after consideration of a letter from Exelon dated May 14, 2003, which provided the basis for the transmission line analysis in the QC license renewal application Environmental Report (ER). A notice of this meeting was issued by the NRC staff on June 3, 2003, and posted on the NRC external public web site (Adams Accession No. ML031550388). There was no public participation in this meeting. The list of attendees is provided in Enclosure 1, and Enclosure 2 is the slides used by Exelon during their presentation.

Exelon provided a discussion of how the consideration of transmission lines in the ER complies with NRC regulations. Exelon discussed the requirement to demonstrate compliance with 10 CFR 51.53(c)(3)(ii)(H) regarding electric shock. Exelon also made a reference to the guidance that was developed prior to the license renewal application being submitted for the Calvert Cliffs Nuclear Power Plant. The Exelon presentation also included a discussion of the applicability of the Endangered Species Act and the National Historic Preservation Act to the transmission line corridors. Exelon stated that they would respond to the RAI no later than the requested July 18, 2003, response date.

At the conclusion of the meeting, the NRC staff stated that the information provided by Exelon during the meeting would be reviewed and a determination would be made regarding Exelons interpretation of the regulations.

Exelon replied to the RAI by a letter dated July 17, 2003. In a letter dated July 24, 2003, the NRC staff informed Exelon that it has determined that Exelons initial interpretation of 10 CFR 51.53(c)(3)(ii)(H) (as reflected in the ER included in the January 3, 2003, license renewal application), was inconsistent with the rule, its regulatory history and the associated Statement of Considerations, as well as the Generic Environmental Impact Statement for License Renewal of Nuclear Plants, NUREG-1437. The July 24, 2003, letter further stated that Exelons July 17, 2003, RAI response reflects an acceptable application of the regulation and no additional information is required.
