ANNUAL ASSESSMENT LETTER - VOGTLE ELECTRIC GENERATING PLANT (NRC INSPECTION REPORT 05000424/2008001 AND 05000425/2008001)

Dear Mr. Tynan:

On February 5, 2008, the NRC staff completed its performance review of Vogtle Electric Generating Plant. Our technical staff reviewed performance indicators (PIs) for the most recent quarter and inspection results for the period from January 1 through December 31, 2007. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility. This performance review and enclosed inspection plan do not include security information. A separate letter designated and marked as "Official Use Only - Security-Related Information" will include the security cornerstone performance review and resultant inspection plan.

Overall, Vogtle Unit 1 and Unit 2 operated in a manner that preserved public health and safety and fully met all cornerstone objectives. Unit 1 plant performance for the most recent quarter was within the Regulatory Response Column of the NRCs Action Matrix due to the Mitigating Systems Performance Index (MSPI), Cooling Water Systems PI crossing the threshold from Green to White. Therefore, in addition to the reactor oversight process (ROP) baseline inspection program, the NRC plans to conduct a supplemental inspection in accordance with Inspection Procedure 95001, Inspection for One or Two White Inputs In a Strategic Performance Area, when you have notified us of your readiness.

Unit 2 plant performance for the most recent quarter as well as the previous three quarters was within the Regulatory Response Column of the NRCs Action Matrix due to the MSPI, Cooling Water Systems PI crossing the threshold from Green to White in the second quarter of calendar year 2006. In May 2007, the NRC conducted a supplemental inspection in accordance with Inspection Procedure 95001, Inspection for One or Two White Inputs in a Strategic Performance Area. As documented in NRC Supplemental Inspection Report 05000425/20070012, your problem identification, root cause, and corrective actions were adequate. However, an additional failure was discovered in the third quarter of 2007 which resulted in the PI remaining in the White performance band. Therefore, in addition to the ROP baseline inspection program, the NRC plans to conduct a supplemental inspection in accordance with Inspection Procedure 95001. This inspection will be conducted in conjunction with the Unit 1 supplemental inspection.

SNC 2 In addition, both Unit 1 and Unit 2 were in the Regulatory Response Column of the NRCs Action Matrix due to a White finding in the Emergency Preparedness Cornerstone that originated in the third quarter of 2006. On February 14, 2008, the NRC completed a supplemental inspection in accordance with Inspection Procedure 95001. The NRC did not identify any new concerns at the exit meeting. The inspection results will be documented in NRC inspection report 05000425/2007502.

The enclosed inspection plan details the inspections, less those related to security, scheduled through June 30, 2009. In addition, we will be conducting NRC Temporary Instructions 171 and 172, reactor operator licensing examinations, license renewal inspections, and in-office review of testing results for containment recirculation sump modifications on both Unit 1 and Unit 2.

The inspection plan is provided to allow for the resolution of any scheduling conflicts and personnel availability issues well in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature. The inspections in the last nine months of the inspection plan are tentative and may be revised at the mid-cycle review.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
