This refers to your letter dated May 21,1996, in which you denied Violation B, t j- Example 1, of the Notice of Violation (NOV) dated April 22,1996. This violation'was i

related to the Final Safety Analysis Report (FSAR) description of connections to the )

i . Spent Fuel Pool (SFP). In our letter dated June 11,1996, we informed you that your q l denial was under further review. We have examined your response and found that it i ! meets the requirements of 10 CFR 2.201.  : i  ! l After reviewing your letter, we agree with your conclusion that Example 1 did not  ! l constitute a violation. We have concluded that the FSAR description is consistent 1 ' with the SFP design. The descriptions in FSAR Sections 9.1.2.3 and 9.1.3.1.3 l referenced in the NOV apply to systems connected directly to the spent fuel pool.  ! ! The refueling canal and fuel transfer tube are outside the isolable boundary of the . j spent fuel pool. Therefore, Example 1 of the violation is withdrawn. I !' Although the FSAR description and SFP design are consistent, the NRC has under l further review the appropriateness of the normal configuration of SFPs and the  ; i asssociated systems and piping connected to the SFP. We will inform you of the . results of our review of this issue in the future.
