Notice ofViolation (NRC Combined Inspection Report Nos. 50-220/91-24 and 50-410/91-24)

This letter refers to the NRC inspection conducted on November 10, 1991 through January 4, 1992, at Nine MileUnit 2, Scriba, New York. The inspection report was sent to you on January 23, 1992.

During the inspection, an apparent violation of NRC requirements was identified. Specifically, maintenance personnel failed to follow a new fuel handling procedure, which led to the dropping of two new fuel bundles on December 19, 1991, rendering them unusable.

On February 6, 1992, an enforcement conference was conducted with you and members of your staff to discuss this violation, its causes and your corrective actions.

Further, we asked you to discuss your overall corrective actions, to address previous inattention-to-detail issues and why those actions had not been fully effective.

The safety consequence of this event was low because the fuel bundles has not been irradiated and there were no radiological consequences.

However, this event in conjunction with other recent issues indicates declining performance with respect to attention-to-detail.

Further, you provided information about a December 16, 1991, precursor to this event where a metal shipping container containing new fuel was lifted without the hold-down plates and safety strap installed.

A supervisor stopped the lift, before the bundles could fall, and directed that the hold-down plates and strap be installed before continuing.

While the supervisor prevented a dropped fuel bundle event then, actions were not taken to prevent the December 19, 1991 event.

We are concerned that your supervisors did not utilize your station corrective action systems in this instance and their errors contributed to the December 19, 1991 event.

Based on the information in the inspection report and that provided at the enforcement conference, a violation of NRC requirements was identified as described in the enclosed Notice of Violation.

In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence.

Afterreviewing your response to this Notice, including your proposed corrective actions, and the results of future inspections, the NRC willdetermine whether further enforcement action is necessary to ensure compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter and the enclosures will be placed in the NRC Public Document Room.

The responses directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub. L.96-511.
