This refers to the NRC special safety inspection conducted on September 1-8, 1987, at Nine Mile Point, Unit 2, to review the violations identified by your staff and reported to the NRC, including a violation of a Technical Specifi-cation Limiting Condition for Operation
{LCO).
The inspection report was sent to you on September 16, 1987.
On October 8, 1987, an enforcement conference was conducted with you and members of your staff to discuss the violations, their causes, and your corrective hctions The enclosed Notice of Violation describes two v'iolations.
The 'first violation includes two examples where Technical Specification requirements were not followed: failure to perform -a required surveillance test of the charcoal adsorber of one train of the Standby Gas Treatment (SBGT) System and the concurrent removal from service of the emergency diesel generator for the other SBGT System train in violation of an LCD. 'hese two examples have been combined as one Severity Level IV violation in accordance with the enforcement policy of 10 CFR 2, Appendix C, because they were both judged to have resulted from the missed surveillance test and to represent consequences of the same error.
Me concluded that Severity.Level IV was appropriate because of the safety significance; that is a missed surveillance followed by a later test of the charcoal adsorber which ronfirmed its Milityto function properly.
The second violation involved the failure to take prompt, effective rorrective action to the lack of meaningful tracking of SBGT System run times identified during an NRC team inspection in June 1987, highlighted to Niagara Hohawk management during daily interim exit meetings. as well as the final inspection exit meeting on June 11, 1987, and documented in Inspection Report 3D-410/87-16

Any-similar violations in the future may result in additional enforcement action, including issuance of a civil penalty or order.
We note another violation referred to in the inspection report, involving the failure to notify the Station Shift Supervisor (SSS) of the potentially inoperable SBGT trains, has not been cited because the Superintendent of Operations, the SSS's immediate supervisor, was aware of the potential SBGT train, inoperability and made a judgment not to involve the SSS with this concern.
You are required to 'respond to the. enclosed Notice.
In your response, you should document the actions taken or planned to prevent recurrence.
After reviewing your response to the Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further enforcement action is necessary to ensure compliance with NRC regulatory requirements.
In accordance with 10 CFR 2.790, a copy of this letter and its enclosures will be placed in the NRC Public Document Room.
The responses directed by this letter and the enclosed Notice are not subject to the clearance procedures of the Office of Management and Budget, otherwise required by -the Paperwork Reduction Act of,1980, Pub.
