NRC INSPECTION REPORT NOS. 50-387/98-05 AND 50-388/98-05 (NOTICE OF VIOLATION)- REPLY

Dear Mr. Byram:

We are in receipt of your letter PLA-5014 of December 15, 1998, in which you responded to the Notice ofViolation issued with NRC Combined Inspection 50-3878388/98-05..That Notice of Violation addressed three examples offailures to comply with the design control requirements of Section III ofAppendix B to Title 10 of the Code of Federal Regulations, Part 50. The Notice of Violation required a response for example 3, which identified an error in the Loss of Coolant Accident calculations which support the use ofAtrium-108 fuel in the reactors at Susquehanna Steam Electric Station.

Section 3 ofAttachment 1 to letter PLA-5014, "Corrective Steps Which WillBe Taken to Avoid Further Violations," documents your long-term corrective actions.

In that section, you state that you willdevelop a formal calculation to evaluate the error associated with core spray flowrate in your licensing basis loss of coolant, accident analysis.

Because your response did not specifically mention correcting the error in the licensing basis, we contacted your staff on December 20, 1998.

During the discussion between Mr. Roy Fuhrmeister of my staff, and Messrs. John Kulickand Chet Lehmann of your Nuclear Fuels Group, we were informed that the calculation you were performing would supersede the erroneous Siemens Power Corporation calculation. We further understand that the Core Operating Limits Report and the Final Safety

Analysis Report forthe Susquehanna Steam Electric Station willbe revised to reflect the updated calculation, updating the licensing basis.

With this additional information, we find your response to the Notice ofViolation acceptable.

Th'ese actions, along with the other corrective and preventive actions documented in your letter of December 15, 1998, willbe examined during a future inspection of your licensed program.
