NOTICE OF VIOLATIONAND NRC SPECIAL INSPECTION REPORT NOS. 50-387/98-09 AND 50-388/98-09
Dear Mr. Byram,
This letter refers to your December 30, 1998, correspondence, in response to our letter and Notice of Violation, dated October 19,1998, for six violations of fire protection requirements at Susquehanna.
The Notice of Violation required a response for one ofthe violations. With respect to your response to that violation, we have reviewed the corrective actions stated in your response, and we understand that you willperform a study to determine the efficacy of revising the minimum water level for operator initiation ofADS such that downcomer water level remains above the top of active fuel. Your letter of December 30, 1998, states that this study willbe completed by July 1, 1999. We willschedule an inspection to review your completed corrective actions subsequent to your final completion date.
You did not, in your response, take issue with any ofthe six violations listed in the Notice.
However, Mr. J. M. Kenny of your staff, in discussions with W. Ruland of the NRC, on January 5, 1999, indicated that he believed the other five violations, which were classified at Severity level IV, were more appropriately minor violations. As a result, we have re-examined the classification of those violations, and agree that violations D and F are more appropriately classifiied as minor violations and not subject to formal enforcement action. Specifically:
With respect to Violation D, "Failure to Properly Handle and LimitTransient Combustibles" the NRC determined that this was an isolated failure to implement a fire protection plan requirement involving two plastic-cased backpack type vacuum cleaners and several mops of transient fire loads. The issue had no programmatic implications and no safety consequence.
With respect to Violation F, "Failure to Perform Annual Physical Examinations for Fire Brigade Members", while the Operations Department change over to biennial physicals did not meet the requirements of procedural requirements of NDAP-QA-0045, all of the fire brigade members had their 1998 annual physicals except for five members who were scheduled for examinations in October 1998. The NRC determined that this failure to implement a procedural requirement had no programmatic implications and no safety impact.
