NRC PROBLEM IDENTIFICATION AND RESOLUTION INSPECTION REPORT 05000361/2010006; 05000362/2010006 AND NOTICE OF VIOLATION

Dear Mr. Dietrich:

Please replace page 11 of the Summary of Findings section in NRC Inspection Report 05000361/2010006; 05000362/2010006 (ADAMS ML102810670), dated July 30, 2010, with the enclosed revised page. Two changes were made to correct typographical errors associated the crosscutting aspect for two findings. The first involves the Severity Level IV noncited violation for the failure to report to the NRC when the licensee was in a condition prohibited by Technical Specifications. Specifically, the error was that the crosscutting aspect had been listed as

P.1(c), when it should have been H.1(a). The description of the crosscutting aspect for this finding has been appropriately modified.

The second change involves the green finding associated with SONGS failure to meet the actions described to the NRC in letters dated April 21, 2009, and October 29 and 30, 2009.

More detail was added to the description of the crosscutting aspect in the summary of findings section, which includes specifying the crosscutting aspect as H.4(c). The changes affect page 11 only, and the changes make the summary of findings consistent with the body of the inspection report.

as such, was evaluated in accordance with the NRC Enforcement Policy. The finding was reviewed by NRC management, and because the violation was determined to be of very low safety significance, was not repetitive or willful, and was entered into the corrective action program, this violation is being treated as a Severity Level IV noncited violation consistent with the NRC Enforcement Policy.

This finding was determined to have a crosscutting aspect in the area of human performance in the decision-making component in that the licensee did not make safety-significant decision using a systematic process, especially when faced with uncertainty. H.1(a) (Section 4OA2.5d)

  • Green. The inspectors identified a Green finding associated with the licensees failure to meet the actions described to the NRC in letters dated April 21, 2009, and October 29 and 30, 2009, addressing corrective actions to improve site performance in the areas of human performance and problem identification and resolution. Specifically, 16 actions were not implemented on time and a number of actions were modified from what was previously described, all prior to informing the NRC. These findings were documented in Nuclear Notification 200848923.

The inspectors determined that the licensees failure to perform actions as documented in its plan to the NRC was more than minor because if left uncorrected could result in a more significant safety concern. Using Inspection Manual Chapter 0609, Appendix M, this finding was reviewed by NRC management and was determined to be of very low safety significance (Green). This finding has a crosscutting aspect in the area of human performance in the work practices component because the licensee did not ensure management oversight of work activities. H.4(c)

B. Licensee-Identified Violations A violation of very low safety significance, which was identified by the licensee, has been reviewed by the inspectors. Corrective actions taken or planned by the licensee have been entered into the licensees corrective action program. This violation and corrective action tracking numbers (condition report numbers) are listed in Section 4OA7.
