NRC INSPECTION REPORT NO. 05000271/2022401, NORTHSTAR NUCLEAR DECOMMISSIONING COMPANY, LLC, VERMONT YANKEE NUCLEAR POWER STATION, VERNON, VERMONT

Dear Mr. Reid:

On November 17, 2022, the U.S. Nuclear Regulatory Commission (NRC) completed a reactive inspection of 10 CFR Part 37 Physical Protection of Category 1 and Category 2 Quantities of Radioactive Materials at the permanently shutdown Vermont Yankee Nuclear Power Station (VY). On-site inspections were performed August 16-18 and October 3-6, 2022. Additional inspection activities (in office reviews) were conducted remotely during the inspection period.

The inspector examined activities conducted under your license as they relate to security and compliance with the Commission's rules and regulations and the conditions of your license. The inspection consisted of a review of procedures and records, interviews of site personnel, and site walkdowns. The results of the inspection were discussed with Mr. Corey Daniels, Independent Spent Fuel Storage Installation (ISFSI) Senior Manager, and other members of the VY staff on November 17, 2022, and are described in the enclosed report.

Based on the results of this inspection, one violation of NRC requirements of very low security significance (Severity Level IV) was identified and is documented in the enclosed report.

Because of the very low security significance and because it was entered into your corrective action program, this violation is being treated as a non-cited violation (NCV), consistent with Section 2.3.2.a of the Enforcement Policy. If you contest the subject or severity of this NCV, you should provide a response within 30 days of the date of this letter, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington DC 20555-0001, with a copy to the Regional Administrator, Region I; and the Director of the Office of Enforcement, U.S. Nuclear Regulatory Commission, Washington, DC 20555-0001.

This letter will be made available for public inspection and copying at http://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390, Public Inspections, Exemptions, Requests for Withholding. The enclosed report contains Security-Related Information, so the enclosed report will not be made publicly available in accordance with 10 CFR 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response Security-Related Information-Withhold from public disclosure under 10 CFR 2.390 in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
