NPF-63 WITHDRAWAL OF REQUEST FOR LICENSE AMENDMENT TO USE OTHER CONTAINMENT WATER LEVEL INSTRUMENTS Ladies and Gentlemen:

In a letter (Serial: HNP-07-040) dated April 30, 2007, Carolina Power & Light Company doing business as Progress Energy Carolinas, Inc., requested approval of a proposed Technical Specification (TS) change for the Harris Nuclear Plant (HNP). The proposed change was to revise the TS to use other narrow range containment sump water level instruments rather than the existing narrow range containment recirculation sump water level instruments.

This amendment was to support the installation of new strainers in the Emergency Core Cooling System (ECCS) recirculation sumps during refueling outage 14 (RFO-14) in the fall 2007 as part of the response to Generic Letter (GL) 2004-02, "Potential Impact of Debris Blockage on Emergency Recirculation during Design Basis Accidents at Pressurized-Water Reactors."

HNP continued to evaluate other options, in addition to the TS change, for modifying the existing ECCS sumps to comply with the commitment made to GL 2004-02. As a result, it was determined that the existing ECCS narrow range sump level instruments could be modified such that the proposed TS change would no longer be needed. On June 7, 2007, HNP discussed the proposed TS change with the NRC via telephone. Following the teleconference, HNP decided to retain the existing ECCS sump level indication in the modified sumps thus eliminating the need to revise the TS. Therefore, HNP requests withdrawal of the proposed TS change to remove ECCS sump level indicators.
