FitzPatrick Nuclear Power Plant Fitness-for-Duty Program Performance Report For the Period July through December 2007 INTRODUCTION 10 CFR 26.71(d) requires that nuclear power plant licensees periodically collect, compile and submit Fitness-for-Duty performance data. Specifically, this performance data must include:

1. Random testing rate;
2. Drugs tested for and cutoff levels, including results of tests using lower cutoff levels;
3. Workforce population tested;
4. Numbers of tests and results by population and type of test (i.e., pre-access, random, for-cause, etc.);
5. Substances identified;
6. Summary of management actions; and
7. A list of events reported.

Fitness-for-Duty performance data for Entergy's James A. FitzPatrick Nuclear Power Plant for the period July through December 2007 are provided below and in the attached tables.

Data on random testing rate, a summary of management actions, and a list of events reported (items,1, 6 and 7) are given below. Data for the remaining items (2, 3, 4 and 5) are given in the attached tables.

An additional section not required by 10 CFR 26 is included in this report. The additional section summarizes events related to the FitzPatrick Fitness-for-Duty Program~and lessons learned.

At JAF, Entergy considers all contractors to be short-term contractors for the purposes of the Fitness-for-Duty Program. For this reason, the attached tables show "zeros" for data associated with long-term contractors.

RANDOM TESTING RATE For this period, 24.58% of employees were tested randomly. The annual random testing rate for 2007 was 53.19%.

SUMMARY

OF MANAGEMENT ACTIONS Entergy used the definition of "Management Actions" implicit in 10 CFR 26.27

("Management actions and sanctions to be imposed") to determine the content of this section.

Pre-Access Testing A total of 69 pre-access tests (7-employees, 62-contractors) were administered. All pre-access tests were negative.

Random Testing A total of 216 random tests (197-employees, 19-contractors) were administered. One employee tested positive for alcohol by a back extrapolation factor of 0.015%/hr. A mandatory EAP referral was completed with a minimal 14-day suspension. Employee was returned to work after signing a re-entry agreement and was placed in the follow-up program for 3 years. All other tests were negative. All contractor random tests were negative.

For Cause Testing There were 2 for-cause tests (1- employee and 1- contractor) for observed behavior during this period. The employee was tested for observed behavior after an emotional outburst.

Test result was negative. A mandatory supervisor's EAP referral was completed and the employee was returned to work after signing a re-entry agreement and was placed under intensive observation. There was 1 contractor for-cause test administered during this period for observed behavior after reporting a DWI arrest. Test result was negative. Individual had no prior history, no other actions were taken.

Follow Up Testing There were 15 follow up tests (11-employees and 4-contractors) administered during this reporting period. All test results were negative.

Other This category includes tests repeated because the results of the specimen were negative but the specimen was determined by the laboratory to have either a low specific gravity or a low concentration of creatinine. There were 5 atypical tests (4 employees and 1 contractor).

All repeat observed test results were negative. There were 5 Department of Transportation (DOT) tests performed on employees (which had a lower alcohol cutoff level at 0.02% BAC).

All test results were negative.

EVENTS REPORTED There were no reportable events during this period. No performance indicators were identified during this period.

LESSONS LEARNED AND PROGRAM EVENTS There were no lessons learned or program events identified during this period.

Fitness-For-Duty performance data for the Entergy's Indian Point Energy Center for the period from July through December 2007 are provided below and in the attached tables.

The random testing rate, a summary of management actions, and a list of events reported (items 1, 6, and 7) are given below. Data for the remaining items (2, 3, 4 and 5) are given in the attached tables.

An additional section not required by 10 CFR 26 is included in this report. The additional section summarizes events related to the Indian Point Energy Center Fitness-For- Duty program and lessons learned.

At IPEC, Entergy considers all contractors to be short-term for the purposes of the Fitness-For-Duty program. For this reason, the attached tables show "zeros" for data associated with long-term contractors.

RANDOM TESTING RATE For this period, 25.42% of the workforce was tested randomly. The annual testing rate for 2007 was 50.60%.

SUMMARY

OF MANAGEMENT ACTIONS Entergy used the definition of "Management Actions" implicit in 10 CFR 26.27

("Management actions and sanctions to be imposed") to determine the content of this section.

Pre-Access Testing A total of two hundred and sixty three (263) pre-access tests were performed (52-employees and 211-contractors).

All employee tests were negative.

Three (3) contractor tests were positive. Two (2) for cocaine, both individuals were denied access to site for three years. One (1) for alcohol, the Individual was denied access to the site for one year.

Random Testing A total of four-hundred and fourteen (414) random tests were performed (339-employees and 75-contractors).

All random tests for employees were negative.

Two (2) contractor tests were positive; One (1) for cocaine and alcohol. One (1) for cocaine. Both individuals were denied access to site for three (3) years.

For-Cause Testing A total of fifteen (15) for-cause (9-employee and 6-contractor) tests were performed. All nine (9) employee tests were for observed behavior. Three (3) contractor tests were for observed behavior and three (3) contractor tests were for post accident.

All for-cause tests for employees and contractors were negative.

Follow-Up Testing A total of twelve (12) follow-up (10-employee and 2-contractor) tests were performed.

All follow-up tests for employees were negative.

One (1) contractor test was positive for cocaine and theindividual was permanently denied access to the site due to violation of Entergy's return to work policy; the other contractor test was negative.

RANDOM TEST RATE During this period, 27.84% of the total workforce was tested. The annual testing rate for 2007 was 52.01%.

SUMMARY

OF MANAGEMENT ACTIONS Entergy used the definition of "Management Actions" implicit in 10 CFR 26.27

("Management actions and sanctions to be imposed") to determine the content of this section.

Pre-Access Testinq During this period, a total of 96 pre-access tests were administered. The breakdown is 39 licensee employees, 0 (zero) long term contractors and 57 short term contractors. All test results were negative.

ATTACHMENT III TO ENOC-08-00010 Random Testing A total of two hundred-twenty-two (222) random tests were performed. Two hundred-seven (207) were licensee employees and fifteen (15) were short term contractors. One licensee employee tested positive for cocaine. The individual was denied access to the site for a minimum of 14 days and was given a mandatory referral to EAP for a full psychological evaluation. This licensee employee has been returned to work and placed in a "follow-up" testing program for three (3) years. All contractor test results were negative.

For-Cause Testing There was no for-cause testing performed this period.

Follow-up Testing A total of 3 fol low-up tests were performed during this period. All tests were performed on licensee employees and all results were negative.

Other This category includes tests repeated because the results of the specimen were negative, but the specimen was determined by the laboratory to have either a low specific gravity or a low concentration of creatinine. A total of three (3) tests in this category were performed on licensee employees. All results were negative.

EVENTS REPORTED There were no events during this time period that required reporting to the NRC. No performance indicators were identified during this period.

LESSONS LEARNED AND PROGRAM EVENTS No notable lessons learned or program events were identified during this period.

RANDOM TESTING RATE For this period, 31.44% of the workforce was tested randomly. The annual testing rate for 2007 was 53.35%.

SUMMARY

OF MANAGEMENT ACTIONS Entergy used the definition of "Management Actions" implicit in 10 CFR 26.27

("Management actions and sanctions to be imposed") to determine the content of this section.

Pre-Access Testing A total of one-hundred-eleven (111) pre-access tests were performed during this period.

Eighteen (18) employees; four (4) long-term contractors and eighty-nine (89) short term contractors.

Two short-term contractor test results were positive. One was for marijuana > 50 ng.,

and one was positive for cocaine. Both were denied access for a minimum of three years.

Random Testing A total of 273 random tests (175 licensee employees, 39 long-term contractors, 59 short-term contractors) were administered during this time period.

Two random tests results were positive. One licensee employee random test received a positive for marijuana >100ng. The licensee employee returned to work after the required 14 days off with EAP intervention and is currently in a follow-up program. One short-term contractor random test received a positive for marijuana >100ng. The short-term contractor was denied access for a minimum of three years.

For-Cause Testinq A total of 3 for-cause tests were performed: 2 observed behavior (1 licensee employee, 1 long term contractor) and 1 post accident (short-term contractor). All three tests results were negative.

Follow-Up Testinq A total of 20 follow-up tests (11 licensee employees, 2 long-term contractors, and 7 short term contractors) were administered during this period. One short-term contractor tested positive for marijuana >50. The short term contractor was denied access for a minimum of three years. All other follow-up tests were negative.

There were 2 atypical tests (1 licensee employee and 1 short-term contractor) administered during this period. Both test results were negative.

EVENTS REPORTED There was one reportable event during this period. An employee licensed operator tested positive for marijuana >100. This employee returned to work after the required 14 days off with EAP intervention and is currently in a follow-up program as well as additional management sanctions which restricted the employee from licensed operator duties. Currently the employee is maintaining his qualifications by attending Licensed Operator requalification (Requal). He has also been assigned to the Training Department to assist with Licensed Operator Requal Training and is also preparing to assist with teaching Auxiliary Operator Initial Training. A plan has been developed which has him gradually returning to licensed operator duties, with assignments in training, at the tagging desk, as an auxiliary operator, and lastly returning to licensed operator duties at the beginning of 2009. He is also being monitored and assessed by Training, Operations and Site Management during this period.

No performance indicators were identified during this period.
